<br />88- 100- I.:".} '.', <br />i)"" () <br /> <br />to select a maximum of at least two more dates during the crop <br />year for the determination of the additional rent due for the <br />balance of 4,720 bushels. In the event that the Landlord <br />designates that the entire 6,720 bushels equivalent be used for <br />such computation on such date, than the entire additional rent <br />shall be fixed at $0.12 per bushel multiplied by 6,720 bushels <br />for total additional rent of $806.40. <br /> <br />5. Irrigation system: The Tenant has had an irrigation <br />well drilled on the premises at his expense and has installed a <br />sprinkler system consisting of the system itself, a pump, and <br />75 h.p. electric motor with control panel. All of such property <br />shall remain the personal property of the Tenant. At any time <br />within sixty (60) days after the expiration of this lease or any <br />extension thereof, the Tenant shall have the right to remove all <br />of said property except for the well or casing itself and any <br />electric lines. Said well or casing shall not in any manner be <br />filled in. If the Tenant at the termination of the lease elects <br />to sell said property which he has the right to remove, the <br />Landlord and their successors or assigns shall have the first <br />right to purchase said property on such terms as are designated <br />by the Tenant for all or any part of said personal property <br />prior to the removal of said property from the real estate <br />within sixty (60) days after the expiration of this lease or any <br />extension thereof. <br /> <br />In the event of repairs or replacement of said equipment <br />and personal property concerning the irrigation system, the <br />Tenant shall pay for the same so that liens will not be filed <br />against the real estate or the Tenant will otherwise take such <br />action as may be necessary to release any such liens from the <br />real estate it~elf. In the event personal property taxes of any <br />type are ever levied against said personal property related to <br />the irrigation system, the Tenant will pay all such personal <br />property taxes during the term of this lease. <br /> <br />6. Tenant's Duties: <br /> <br />a. Tenant will not commit waste or damage to <br />the real estate. However, the Tenant shall <br />have the right to eliminate low spots on the <br />real estate at its expense by doing whatever <br />land leveling is necessary provided that such <br />land leveling is accomplished in a workmanlike <br />manner. The Tenant may also create driveways <br />to the center of the irrigation pivot. <br /> <br />b. Tenant shall operate the farm in an efficient <br />and husbandlike manner specifically including <br />keeping the cultivated land free of weeds con- <br />sistent with good farming practices. Tenant's <br />operation may be used for the raising of seed <br />corn, other seed, or other uses where crops may <br />not be as intense and there may be more weeds <br />than are used in other types of farming practices <br />as long as the Tenant makes use of good farming <br />practices pertaining to the use to which it puts <br />the land. <br /> <br />I.A'" OI'I'IC;J;S <br /> <br />IlIlonK, S~lum <br /> <br />Be SMITH <br /> <br />c. Tenant shall take all reasonable measures to <br />avoid and prevent erosion on the premises <br />inclUding terracing of the land at the Tenant's <br />cost if such terracing is deemed necessary by <br />government soil conservation authorities.
