The subdivider agrees to landscape an <br />area averaging thirty feet in width adjacent to Webb Road. Such <br /> <br />landscaping shall be completed within one planting season after <br /> <br />issuance of the occupancy permit for the principal structue on <br /> <br />Lot 8. <br /> <br />9. Warranty. The Subdivider warrants that it is the owner <br />in fee simple of the land described and proposed to be known as <br /> <br />REPLAT OF LOT EIGHT, GRAND ISLAND f.lALL EIGHTH SUBDIVISION, and <br /> <br />that an abstract of title or a copy of a valid title insurance <br /> <br />pOlicy will be submitted for examination, if necessary, upon <br /> <br />request of the City cf Grand Island. <br /> <br />10. This agreement shall run with the land and shall be <br />binding upon and inure to the benefit of the parties hereto, <br /> <br />their successors and assigns.
