Mortgagor shall immediately notify Beneficiary <br />any such separate insurance policy is obtained and shall <br />deliver to Beneficiary the policy or certificate evidenc- <br />insurance. <br /> <br />1.6.4 Mortgagor shall, immediately upon receipt of <br />any written notice of any failure by Mortgagor to pay any insur- <br />ance premium in respect of any insurance required to be maintained <br />under Section 1.6.1, furnish a copy of such notice to Beneficiary. <br /> <br />SECTION 1.7 Failure to Make Certain Payments. If <br />Mortgagor shall fail to perform any of the covenants contained in <br />this Deed of Trust or the Loan Agreement, Beneficiary may make <br />advances to perform the same on its behalf, and all sums so <br />advanced shall be included in the Indebtedness and be secured <br />hereby. Mortgagor shall repay on demand all sums so advanced by <br />Beneficiary on behalf of Mortgagor, with interest at the Default <br />Rate. The provisions of this Section 1.7 or any action taken by <br />Beneficiary pursuant to the provisions of this Section 1.7 shall <br />not prevent any such failure to observe any covenant contained in <br />this Deed of Trust from constituting an Event of Default (as <br />hereinafter defined). <br /> <br />SECTION 1.8 ~ection. Mortgagor shall permit Benefi- <br />ciary, by its agents, accountants or attorneys, upon reasonable <br />advance notice, written or oral, except in cases of emergency, to <br />visit and inspect the Premises at such reasonable times as may be <br />requested by Beneficiary. <br /> <br />SECTION 1.9 Mortgagor to Maintain Improvements. Mort- <br />gagor shall not commit any waste on the Premises or make any <br />change in the use of the Improvements or Personal Property or use <br />any of the Land for purposes not related to the current use of the <br />Premises without Beneficiary's prior written consent. Mortgagor <br />shall, at all times, maintain the Premises in good operating <br />order, condition and repair. Except as otherwise provided in <br />Section 1.14, the Premises shall not be demolished or altered, nor <br />shall any Personal Property be removed without the prior written <br />consent of Beneficiary, except to the extent permitted in the Loan <br />Agreement. <br /> <br />SECTION 1.10 Mortgagor's Obligations With Respect to <br /> <br />Leases. <br /> <br />1.10.1 Mortgagor shall not without the Beneficia- <br />ry's prior written consent (i) execute any assignment of any Lease <br />or of the rents or any part thereof from the Premises other than <br />the assignment herein to Beneficiary, (ii) except where the lessee <br />under any Lease is in default thereunder, terminate or consent to <br />the cancellation or surrender of such Lease, (iii) modify any <br />Lease having an unexpired term of two (2) years or more so as to <br />change the unexpired term thereof or so as to decrease the amount <br />of the rents payable thereunder, (iv) accept any prepayments of <br />any installment of rents to become due under any Lease for a <br /> <br />-11- <br /> <br />L <br /> <br />L <br /> <br />~. <br /> <br />L <br /> <br />r-- <br /> <br />~ <br /> <br />~ <br />l~ <br />
