<br />SUBDIVISION AGREEMENT <br /> <br />200700893 <br /> <br />Page 2 01'4 <br /> <br />SUBDIVIDER agrees to extend its privately owned water lines within the addition at SUBDIVIDER's <br />expense for a connection in accordance with plans and specifications to be submitted and approved by <br />the City of Wood River Utilities Department. The water lines within the additon shall be privately <br />owned and maintained by the SUBDIVIDER. <br />3. SMi1gl)'_S~w~r. Public sanitary sewer is available to the additon and the SUBDIVIDER <br />agrees to extend, connect and provide sanitary sewer service to all lots within the addition by way of a <br />private sewer line system, at the time of their development, in accordance with plans and specifications <br />to be approved by the City of Wood River Utilities Superintendent. The sewer line within the addition <br />shall be privately owned and maintained by the SUBDIVIDER. <br />4. St0l111Drainag~. The SUBDIVIDER agrees to grade all lots in the addition in conjunction <br />with the development proposed thereon so that storm drainage is conveyed to a public right-of-way or to <br />other drainage systems so approved by the City of Wood River Street Utilities Superintendent. <br />5. Landscaping. The SUBDIVIDER agrees to comply with the requirements of any landscaping <br />regulations of the City of Wood River pertaining to the zoning designation of this addition. <br />6. Sidewalks. The SUBDIVIDER shall install all public sidewalks required by the City of <br />Wood River when the lots are built upon and such sidewalks shall be regulated and required with <br />building permit for each such lot. <br />7. Engineering Data. All final engineering plans and specifications for improvements shaH be <br />furnished by the SUBDIVIDER to the Wood River Utilities Superintendent for approval prior to <br />contracting for construction of any improvements. <br />8. Warranty. The undersigned owner and SUBDIVIDER, warrants that it is the owner in fee <br />simple of the land described and proposed to be known as CARGILL ADDITION, and that an abstract <br />of title or title insurance commitment will be submitted for examination, if necessary, upon request of <br />the City of Wood River. <br />9. Binding Effect. This agreement shaH run with the land and shall be binding upon and enure <br />to the benefit of the parties hereto, their successors, assigns, devisees and legatees. For the term <br />"SUBDIVIDER" is used in this agreement, the subsequent owners of any lots in the subdivision shall be <br />responsible to perform any of the conditions of this agreement if the SUBDIVIDER has not performed <br />such conditions. .
