SUBDIVISION AGREEMENT 200700893 Page 2 01'4 SUBDIVIDER agrees to extend its privately owned water lines within the addition at SUBDIVIDER's expense for a connection in accordance with plans and specifications to be submitted and approved by the City of Wood River Utilities Department. The water lines within the additon shall be privately owned and maintained by the SUBDIVIDER. 3. SMi1gl)'_S~w~r. Public sanitary sewer is available to the additon and the SUBDIVIDER agrees to extend, connect and provide sanitary sewer service to all lots within the addition by way of a private sewer line system, at the time of their development, in accordance with plans and specifications to be approved by the City of Wood River Utilities Superintendent. The sewer line within the addition shall be privately owned and maintained by the SUBDIVIDER. 4. St0l111Drainag~. The SUBDIVIDER agrees to grade all lots in the addition in conjunction with the development proposed thereon so that storm drainage is conveyed to a public right-of-way or to other drainage systems so approved by the City of Wood River Street Utilities Superintendent. 5. Landscaping. The SUBDIVIDER agrees to comply with the requirements of any landscaping regulations of the City of Wood River pertaining to the zoning designation of this addition. 6. Sidewalks. The SUBDIVIDER shall install all public sidewalks required by the City of Wood River when the lots are built upon and such sidewalks shall be regulated and required with building permit for each such lot. 7. Engineering Data. All final engineering plans and specifications for improvements shaH be furnished by the SUBDIVIDER to the Wood River Utilities Superintendent for approval prior to contracting for construction of any improvements. 8. Warranty. The undersigned owner and SUBDIVIDER, warrants that it is the owner in fee simple of the land described and proposed to be known as CARGILL ADDITION, and that an abstract of title or title insurance commitment will be submitted for examination, if necessary, upon request of the City of Wood River. 9. Binding Effect. This agreement shaH run with the land and shall be binding upon and enure to the benefit of the parties hereto, their successors, assigns, devisees and legatees. For the term "SUBDIVIDER" is used in this agreement, the subsequent owners of any lots in the subdivision shall be responsible to perform any of the conditions of this agreement if the SUBDIVIDER has not performed such conditions. .
