"Lot" shall mean and refer to any platted lot of land upon the recorded <br />subdivision plat of the Properties and shall include only: <br /> <br />i. Lots One (1) through Six (6), Block Three (3) and Lots One (1) <br />through Eight (8), Block Four (4), all in Summerfield Estates First <br />Subdivision in the City of Grand Island, Hall County, Nebraska, <br />such plat being recorded in the Office of the Register of Deeds of <br />Hall County, Nebraska; and <br /> <br />ii. Lots One (1) through Six (6), Block One (1) and Lots Five (5) <br />through Eight (8), Block Two (2), all in Summerfield Estates Fifth <br />Subdivision in the City of Grand Island, Hall County, Nebraska, <br />and Lots One (1) through Four (4), all in Summerfield Estates <br />Sixth Subdivision in the City of Grand Island, Hall County, <br />Nebraska, (a replat of Lots One (1) through Four (4), Block Two <br />(2) in Summerfield Estates Fifth Subdivision in the City of Grand <br />Island, Hall County, Nebraska. <br /> <br />3. Every Owner of a Lot within the Properties shall be a member of the Association. <br />Membership in the Association is a condition of ownership of any Lot within the Properties. <br />Membership shall be appurtenant to and may not be separated from ownership of any Lot which <br />is subject to assessment. The Association shall have one class of voting membership which shall <br />be and include the Owner of each Lot contained in the Properties. When more than one (1) <br />person holds an interest in any Lot contained within the Properties, all such persons shall be <br />members of the Association but any vote for such Lot shall be exercised as they among <br />themselves determine with no more than one (1) vote being cast with respect to any Lot. <br /> <br />4. Each Owner of any Lot contained within the Properties agrees to this <br />DECLARA nON OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />FOR SUMMERFIELD ESTATES FIRST SUBDIVISION HOMEOWNERS ' ASSOCIATION <br />AND SUMMERFIELD EST A TES FIFTH AND SIXTH SUBDIVISIONS HOMEOWNERS' <br />ASSOCIATION by acceptance of any conveyance of: <br /> <br />a. Lots One (1) through Six (6), Block Three (3) or Lots One (1) through Eight (8), <br />Block Four (4), all in Summerfield Estates First Subdivision in the City of Grand <br />Island, Hall County, Nebraska; and <br /> <br />b.
