<br />200610211 <br /> <br />1. MUTUAL EASEMENTS. There shall be as between the owners <br />of the above described properties an easement for ingress and <br />egress over so much of the respective properties as is presently <br />improved as part of the driveway for use of vehicular traffic used <br />in connection with the respective properties. However, there is <br />room for each of the owners of the respective properties to park <br />on their own driveway and they will not park on each other's <br />driveway. <br /> <br />2. OBSTRUCTIONS. The owners of the properties shall not <br />obstruct, impede or interfere one with the other, in the <br />reasonable use of such driveway improvements for the purpose of <br />ingress and egress to and from the respective properties. <br /> <br />3. MAINTENANCE. The owners of each property shall <br />maintain the respective driveway improvements in a useable, neat, <br />and uniform manner, so that the overall appearance of said <br />driveway improvements is that of one driveway. The owners of each <br />property will stand the expense of upkeep and/or replacement of <br />its respective driveway. If either of the owners of said property <br />should create damage to the other's driveway, the one causing the <br />damage should stand the expense of repairs. <br /> <br />4. GARAGE. The owners of each property agree to maintain <br />their respective one-half of the common garage in good condition <br />and repair at all times. Each owner shall confer with the other <br />regarding painting, roofing, and other repairs so as to make the <br />respective portion of the common garage compatible in appearance <br />and structu:r:'ally sound at all times. Each owner shall be <br />responsible for the cost of maintenance of that part of the common <br />garage located on their respective property. Neither owner shall <br />structurally alter, demolish or remove such owner's respective <br />one-half of the common garage without the consent of the other, <br />nor shall either owner interfere with the other owner's rightful <br />use of the garage. <br /> <br />If the common garage is damaged or destroyed by fire, <br />wind or other casualty loss, the owners agree to repair or rebuild <br />the common garage and each owner shall bear the cost of their <br />respective one-half of the common garage. <br /> <br />5. <br />construed <br />and shall <br />assigns. <br /> <br />BINDING EFFECT.
