<br />200609368 <br /> <br />ARTICLE XI <br />SEPARATE TAXATION <br /> <br />Declarant shall give written notice to the Hall County Assessor of the creation of the <br />condominium property regime so that each Unit or garage, including the undivided interest in the <br />common elements appurtenant thereto, shall be deemed a parcel and subject to separate assessment and <br />taxation. <br /> <br />ARTICLE XII <br />EASEMENTS <br /> <br />Easements are hereby reserved and granted from and to Declarant and each Owner for <br />encroachment if any part of a condominium Unit or garage or the common elements or if any such <br />encroachment shall hereafter occur due to the settling or shifting of a building or for any other reason, or <br />if such building is repaired or rebuilt after damage or destruction. The Association shall have an <br />easement in and upon each Unit for the performance of repairs upon the common elements and for <br />emergency repair to any part of the condominium property or Unit. <br /> <br />ARTICLE XIII <br />TERM OF DECLARATION <br /> <br />This Declaration shall run with the land, shall be binding upon all Persons owning Units and any Persons <br />hereafter acquiring said Units, and shall be in effect in perpetuity unless amended or terminated as <br />provided herein. <br /> <br />ARTICLE XIV <br />AMENDMENT OF DECLARATION <br /> <br />Except as otherwise provided in the Act and this Declaration, any provision, covenant, condition, <br />restriction or equitable servitude contained in this Declaration may be amended or repealed at any time <br />and from time to time upon Approval of the amendment or repeal by all Members of the Association <br />present in person or by proxy at a duty constituted meeting of the Members. The Approval of any such <br />amendment or repeal shall be evidenced by the certification by the Board of Directors of the Association <br />of the vote of Members. The amendment or repeal shall be effective upon the recordation in the office of <br />the Register of Deeds of Hall County, Nebraska, of a certificate, executed by the President and Secretary <br />of the Association setting forth the amendment or repeal in full and certifying that the amendment or <br />repeal has been Approved by the Members and certified by the Board of Directors as set forth above. <br /> <br />ARTICLE XVI <br />NOTICE AND REQUES~S <br /> <br />All notices required hereby shall be in writing and sentby certified or registered mail: <br /> <br />(a) To an Owner: At his or her last known address on the books of the Association. <br /> <br />(b) To the Association: At the registered office of the Association. <br /> <br />EXECUTED this JkJOi; day of <br /> <br />Cld-. <br /> <br />, 2006. <br /> <br />~~ <br /> <br />Robert E.
