<br />. . <br /> <br />200609368 <br /> <br />other improvements upon the land as set forth in this Declaration as a part of the condominium regime. <br /> <br />(c) "Common Elements" shall mean all portions of a condominium other than the Units. The <br />Common Elements include the right to maintain and use, and to the extent necessary for the <br />Association to obtain access and perform its duties with respect to the Common Elements, all utility <br />easements, access easements, pedestrian access easements and landscaping easements as shown on <br />the Plat or Maps. <br /> <br />(d) "Limited Common Elements: means: <br /> <br />(1) If any chute, flue, duct, wire, conduit, bearing wall, bearing column, or any other <br />fixture lies partially within and partially outside the designated boundaries of a Unit, any portion thereof <br />serving only that Unit is a limited common element allocated solely to that Unit, and any portion thereof <br />serving more than one Unit or any portion of the common elements is a part of the common elements. <br /> <br />(2) Any shutters, awnings, window boxes, doorsteps, stoops, porches, balconies, patios, <br />and all other fixtures designated to serve a single Unit, but located outside the Unit's boundaries, are <br />limited common elements allocated exclusively to the use of that Unit. <br /> <br />(e) "Owner" shall mean a Unit owner as defined in the Condominium Act. <br /> <br />(f) "Unit" shall mean the enclosed space within the two (2) residential living Units identified as <br />Units 580 and 584 as shown on the plats attached hereto as Exhibits "A" and "B"; the garage attached to <br />each Unit and the basement under each Unit; all airspace in rooms and attics; air conditioning <br />compressors for Units; screening, exterior and interior window glass, exterior and interior doors, interior <br />surfaces of all floors, ceilings and walls (including sheetrock and finishings) within the Unit and to the <br />centerline of all interior dividing walls but shall not include structural walls, roofs, floors and ceilings, <br />except for the Unit-side surfaces thereof, which shall all be included in the definition "Unit". <br /> <br />ARTICLE IV. <br />DESCRIPTION, MEMBERSHIP, VOTING RIGHTS AND ALLOCATIONS <br /> <br />(a) Description. The condominium consists of one (1) building and a total of two (2) Units which <br />includes basement area and garage. Units 580 and 584 are each one (1) story in height and may only be <br />used for residential purposes. The condominium regime also includes yard area and landscaping. Said <br />buildings and improvements, together with their location on the land and the area and location of each <br />Unit are more particularly described in the plans which is hereto attached as Exhibits "A" and "W. <br /> <br />(b) Membership. Every owner of any Unit shall be a member of the Association, excluding persons <br />who hold only a Security Interest. Membership shall be appurtenant to and may not be separated from <br />ownership of any Unit. Ownership of such Unit shall be the sole qualification for membership. When <br />more than one (1) person holds an ownership interest in any Unit, all such persons shall be Members; <br />however, the vote for such Unit shall be exercised as they among themselves determine but in no event <br />shall more than one (1) vote be cast with respect to any Unit. <br /> <br />(c) Allocated Interests.
