<br />THIS CONDOMINIUM DECLARATION for P and F CONDOMINIUM PROPERTY REGIME
<br />("Declaration") is made and entered into thi~day of October, 2006, by Robert E. Potter and Kathleen
<br />K. Potter, Husband and Wife ("Declarantll).
<br />
<br />ARTICLE I
<br />RECITALS
<br />
<br />(a) Declarant is the owner of certain real property described as:
<br />
<br />Lot Nine (9), Block One (1), in Southern Acres
<br />Addition to the City of Grand Island, Hall
<br />County, Nebraska (the "Property").
<br />
<br />(b) Declarant desires to and hereby creates a Condominium on the Property pursuant to the Nebraska
<br />Condominium Act, Neb. Rev. Stat. ~ 76-825, et seq., as amended from time to time ("Act"), in which
<br />portions of the Property are designated for separate ownership and the remainder of which are
<br />designated for common ownership solely by the Unit Owners, through P and F CONDOMINIUM
<br />HOMEOWNERS ASSOCIATION, a Nebraska Nonprofit Corporation (" Association").
<br />
<br />(c) Declarant has incorporated the Association for the purpose of exercising the functions herein set
<br />forth.
<br />
<br />ARTICLE II
<br />SUBMISSION OF PROPERTY
<br />
<br />Declarant hereby publishes and declares that the Property shall be owned, sold, conveyed,
<br />transferred, leased, encumbered and occupied subject to the easements, covenants, conditions, and
<br />restrictions which are for the purpose of protecting the value and desirability of the Property, and which
<br />shall run with the Property and shall be binding upon and inure to the benefit of all parties having any
<br />right, title, or interest in the Property, or any portion thereof, their heirs, personal representatives,
<br />successors, and assigns. Additionally, Declarant hereby submits the Property to the provisions of the Act.

<br />ARTICLE III.
<br />DEFINITIONS
<br />
<br />Except as hereinafter noted, the definitions set forth in Nebraska Revised Statute Section 76-827 shall
<br />govern this Declaration and the Bylaws of P and F CONDOMINIUM HOMEOWNERS ASSOCI A TION, a
<br />Nebraska Nonprofit Corporation.
<br />
<br />(a) "Association" shall mean the P and F CONDOMINIUM HOMEOWNERS ASSOCIATION, a
<br />Nebraska Nonprofit Corporation. Each Owner shall be a member of the Association.

<br />(b) "Condominium" shall mean the entire condominium project including all buildings, land, and
