<br />200609094 <br /> <br />(c) No digital satellite dish larger than twenty inches in diameter shall be <br />permitted and any such permitted satellite dish shall be located and screened so as <br />to be as unobtrusive as is reasonably possible. <br /> <br />(d) No motor homes, campers, semi-trucks, boats or other recreational <br />vehicles of whatever kind or description shall be parked upon any driveway <br />located upon the Properties for any period in excess of twenty-four (24) hours. <br /> <br />(e) Owner shall comply with all other requirements imposed by Amick <br />Acres West Homeowners Association, Inc. Restrictive Covenants and Conditions <br />appearing in that instrument recorded as Document No. 97-110353 in the office of <br />the Hall County Register of Deeds and requirements of applicable regulations <br />imposed by Hall County, Nebraska. <br /> <br />6. Any wall constructed on any common lot line between two adjoining lots within the <br />Properties shall be a party wall. Any expense of structural repair, replacement or reconstruction <br />of a party wall, or of the protection of a party wall against the natural elements, shall be borne <br />equally by the Owners who are the title holders of the adjoining lots and otherwise be governed <br />by the terms of the Party Wall Agreement being recorded concurrently herewith. The provisions <br />ofthis paragraph shall not operate to relieve any Owner from any liability that the Owner may <br />incur by reason of negligent or willful acts or omissions resulting in damage to a party wall. <br /> <br />7. Each Owner shall be responsible for the proper storage and disposal of all construction <br />debris and materials associated with the construction of any improvement upon their Lot. Until <br />construction shall be completed upon the lot, they shall be periodically mowed and loose debris <br />and material picked up and properly stored to prevent such loose debris and material from being <br />spread and blown throughout the Properties. During construction on any Lot, the Owner of that <br />Lot shall be responsible to erect and maintain adequate erosion control measures, including silt <br />fences, straw bales, or other measures to prevent soil runoff upon adjoining properties or streets. <br />Each Owner shall be responsible for the enforcement and monitoring of all contractors and <br />suppliers performing work upon their Lot. Each Owner shall be responsible for maintaining any <br />improvements on their Lot in a neat, safe, and attractive manner. <br /> <br />8. Unless hereafter amended by unanimous consent of the all Owners, these <br />restrictive covenants, restrictions and conditions are to run with the land and shall be binding on <br />all persons and all parties claiming ownership of the Real Estate together with any portion or <br />subsequent resubdivision of those lots, until January 1,2014 at which time these Restrictive <br />Covenants, Restrictions and Conditions shall be automatically extended for successive periods of <br />ten (10) years, unless changed or modified by a vote of a majority of the then owners ofthe Real <br />Estate together with any portion or subsequent resubdivision ofthose lots. <br /> <br />9. If any Owner ofthe Real Estate or subsequent resubdivision of those lots, or their <br />heirs, devisees, personal representatives, successors, assigns or grantees, shall violate any of the <br />restrictive covenants, restrictions and conditions herein set forth, it shall be lawful for any other <br />person or persons owning any other portion ofthe Real Estate, together with any portion or <br />subsequent resubdivision of those lots, to prosecute such proceedings at law or in equity against <br />the person or persons violating or attempting to violate any such restrictive covenants, restric- <br />tions or conditions and to prevent him from so doing or to recover damages for such violations. <br /> <br />10. If any of the restrictive covenants, restrictions or conditions herein set forth are <br />violated and declared void by a court of competent jurisdiction, the remaining restrictive cove- <br />nants, restrictions and conditions shall not be affected, but shall stay and remain in full force and <br />effect. <br /> <br />IN WITNESS WHEREOF, the undersigned have executed this Amended Declaration of <br />Restrictive Covenants effective as of the date first noted ab::eo/ A <br /> <br /> <br />11IJ~ <br />Andrew W.
