<br />200609094 <br /> <br />West Fourth Subdivision, Hall County, Nebraska, all as surveyed and platted and is more <br />particularly described as recorded in the office ofthe Register of Deeds of Hall County, <br />Nebraska. <br /> <br />IV. <br />RESTRICTIVE COVENANTS. RESTRICTIONS AND CONDITIONS <br /> <br />1. In consideration ofthe mutual benefits to be derived by the owners ofthe Real Estate <br />and any purchaser or purchasers, their heirs, devisees, personal representatives, successors, as- <br />signs or grantees, the Declarants stipulate and agree that all Real Estate hereinabove described <br />sold, transferred or conveyed, shall be and are subject to the following restrictive covenants, <br />restrictions and conditions except as provided herein. All restrictive covenants, restrictions and <br />conditions shall run with the land and are as follows: <br /> <br />2. The following definitions shall apply to this Amended Declaration of Restrictive <br />Covenants: <br /> <br />a. "Owner" shall mean an owner of Lots One (1) and Two (2), all in <br />Amick Acres West Fourth Subdivision, Hall County, Nebraska or any portion or <br />resubdivision thereof. <br /> <br />b. "Properties" shall mean and refer to Lots One (1) and Two (2), all in <br />Amick Acres West Fourth Subdivision, Hall County, Nebraska or any portion or <br />subsequent resubdivision of those lots. <br /> <br />c. "Lot" shall mean and refer to any platted lot of land upon the recorded <br />subdivision plat ofthe Properties and shall include only Lots One (1) and Two <br />(2), all in Amick Acres West Fourth Subdivision, Hall County, Nebraska together <br />with any portion or subsequent resubdivision of those lots. <br /> <br />3. Each Owner of any Lot contained within the Properties, or any portion thereof, <br />including subsequent lots created by a subsequent resubdivision of these current lots, agrees to <br />this Amended Declaration of Restrictive Covenants, whether or not it is so expressed in any such <br />conveyance. <br /> <br />4. The following standards shall be applicable to all dwelling units constructed within <br />the Properties: <br /> <br />(a) The minimum floor area for any dwelling structure, exclusive of <br />basements, garages, porches, patios, decks or enclosed decks shall be One <br />Thousand Five Hundred (1,500) square feet above ground. <br /> <br />(b) Setbacks of dwellings from the lot lines shall be as required by the <br />Amick Acres West Homeowners Association, Inc. Restrictive Covenants and <br />Conditions recorded as Document No. 97-110353 in the otlice of the Hall County <br />Register of Deeds. <br /> <br />(c) All exterior colors shall be aesthetically pleasing and shall not include <br />any loud, bright or obnoxious color schemes. <br /> <br />(d) Any dwelling unit shall be completed within twelve (12) months after <br />the commencement of construction. <br /> <br />(e) Owner shall comply with all other requirements imposed by Amick <br />Acres West Homeowners Association, Inc. Restrictive Covenants and Conditions <br />appearing in that instrument recorded as Document No. 97-110353 in the office of <br />the Hall County Register of Deeds and applicable regulations imposed by Hall <br />County, Nebraska. <br /> <br />5. The following standards shall be applicable to the construction and installation of <br />improvements other than the dwelling unit. <br /> <br />(a) Accessory structures such as storage sheds, playhouses or detached <br />garages must be first approved by the Architectural Committee of Amick Acres <br />West Homeowners Association, Inc. <br /> <br />(b) Plans and specifications for the construction and placement of all dog <br />kennels shall be first approved by the Architectural Committee of Amick Acres <br />West Homeowners Association, Inc. <br /> <br />2 <br />
