<br />200608209 <br /> <br />4. Storm Drainage. The Subdivider agrees to grade all lots in the subdivision in <br /> <br />conjunction with the development proposed thereon so that storm drainage is conveyed to a public <br /> <br />right-of-way or to other drainage systems approved by the Director of Public Works. <br /> <br />5. Sidewalks. The Subdivider shall maintain all public sidewalks required by <br /> <br />the City of Grand Island. <br /> <br />6. Easements. Any easements shall be kept free of obstructions and the <br /> <br />Subdivider shall indemnify the City for any removal or repair costs caused by any obstructions. <br /> <br /> <br />7. Electrical Lines. Existing electrical lines cross Lots One ( 1 ) and Two (2) of <br /> <br /> <br />the subdivision to provide electrical service to the structure on the northern part of Lot One (1), <br /> <br /> <br />Block Twenty Two (22), Nagy's Subdivision. These electrical lines have historically served this <br /> <br />property from the current location and the owners agree to let the situation continue for an indefinite <br /> <br />period of time. <br /> <br />8. Construction. The building on Lot Two (2) of the proposed subdivision has <br /> <br /> <br />at some point in time had a building addition constructed to the south that does not comply with <br /> <br /> <br />building codes as adopted by the City of Grand Island. Within six months of the approval of this <br /> <br />subdivision, the owner shall obtain permits and have the construction complete to bring this facility <br /> <br />into compliance with the applicable building, electrical, plumbing and mechanical codes. <br /> <br />9. Use. The proposed Lot Two (2) ofthis subdivision has in the past been a legal <br /> <br />nonconforming property as the property is zoned R-4 high density residential and the use has been <br /> <br />that of a commercial storage building. Continued uses may either be residential as allowed in the <br /> <br />zoning code or continued nonconforming uses compatible with that of a storage use may continue <br /> <br />- 3 - <br />
