200608209 as to accuracy of survey by a registered land surveyor, and to contain a dedication ofthe easements to the use and benefit of public utilities, and of the street to the use of the public forever. In consideration of the acceptance of the plat of said NAGY'S SECOND SUBDIVISION, the , Subdivider hereby consents and agrees with the City of Grand Island, Nebraska, that it will install or provide at its expense the following improvements: I 1. Paving. The Subdivider agrees to waive the right to object to the creation of any paving or repaving district for Vine Street where it abuts the subdivision. 2. Water. Public water is available to the subdivision and the Subdivider agrees to extend, connect and provide water service to all lots in the subdivision in accordance with plans and specifications approved by the Director of Public Works, and subject to the City's inspection. 3. Sanitary Sewer. Public sanitary sewer is available to the subdivision. Currently the north portion of Lot One (1), Block Tweny- Two (22) of Nagy's addition and the proposed Lot One (1) of Nagy's Second are connected by a common sanitary sewer service extending across all property lines to the main sewer line in the public alley south of the properties. The proposed Lot Two (2) has a private sewer service extending across proposed Lot 1 and connected to the public sewer main in the south alley. As all of these sewer connections currently cross in front of adjacent property lines to get to the public main in violation of existing plumbing codes. At such time as the common sanitary sewer services to the north portion of Lot One (1), Block Twenty-Two (22) of Nagy's Addition and the proposed Lot I of Nagy's Second Addition need repairs or replacement the services shall be brought into compliance with existing city codes and served with independent sanitary service lines connected to public mains as approved by the City of Grand Island. - 2 -
