J. Cunningham, Jr., after being first duly sworn <br />on oath, deposes and states as follows: <br /> <br />1. That Affiant has practiced law in Grand Island, Hall <br />County, Nebraska, for more than fifty years last past and was well <br />acquainted with Alvin Denman, also known as Alvin A. Denman, and <br />his sister, Dorothy Lepp, both now deceased. That said persons <br />had inherited from their parents certain Hall County real estate <br />and during the year 1977 they transferred the properties one to <br />the other as they deemed necessary and advisable. <br /> <br />2. At the request of the two above named persons, the <br />undersigned prepared a Warranty Deed dated, executed and <br />acknowledged by them on May 4, 1977, transferring hereinafter <br />described real estate from Alvin Denman to Dorothy Lepp which <br />Warranty Deed was recorded in the office of the Hall County <br />Register of Deeds as Document No. 77-002778. That said deed also <br />conveyed another 40 acre tract and that the conveyance in question <br />described the one 40 acre tract of real estate transferred as <br />follows: <br /> <br />THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER <br />(NE1/4 SE1/4), SECTION TWENTY-TWO (22), TOWNSHIP <br />ELEVEN (11) NORTH, RANGE TEN (10) WEST OF THE <br />6TH P.M., HALL COUNTY, NEBRASKA, "for and during <br />the term of the natural lifetime of the Grantee", <br />(i talics added) <br /> <br />that the above described deed failed to dispose of the remainder <br />interest in said property after the death of the life tenant, <br />Dorothy Lepp. <br /> <br />3. On May 4, 1977, the undersigned discovered the above <br />omission of the disposition of the remainder estate and prepared a <br />Corrective Warranty Deed conveying the above described property to <br /> <br />~s;so <br />
