<br />KNOW ALL MEN BY THESE PRESENTS that GREGORY L. GALLES, is the Successor
<br />Trustee under a Deed of Trust executed February 20,2003, by CLARENCE L. SKARNIAK and JULIE A.
<br />SKARNIAK, husband and wife, Trustors, in which PRIMARY RESIDENTIAL MORTGAGE, INC.,
<br />was named as Beneficiary and FIRST AMERICAN TITLE INSURANCE COMPANY, as Trustee, and
<br />which was filed for record on March 7, 2003, as Instrument No. 2003-02740 in the office of the Register of
<br />Deeds of Hall County, Nebraska. Said Deed of Trust was assigned by the original Beneficiary, PRIMARY
<br />RESIDENTIAL MORTGAGE, INC., to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS,
<br />IN c., AS NOMINEE FOR U.S. BANK, N .A., by virtue of an Assignment dated February 27, 2003, and filed
<br />for record on April 7, 2003, as Instrument No. 2003-04132 in the office of the Register of Deeds of Hall
<br />County, Nebraska. GREGORY L. GALLES was appointed Successor Trustee by virtue of a Substitution of
<br />Trustee dated January 27,2006, and recorded February 1,2006, as Instrument No. 2006-00900 in the Office of
<br />the Register of Deeds for Hall County, Nebraska. GREGORY L. GALLES, Grantor, in consideration of the
<br />sum of Seventy Seven Thousand Five Hundred Fifty Two and 87/100 ($77,552.87) and other good and
<br />valuable consideration received from MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC.,
<br />AS NOMINEE FOR U.S. BANK, N.A., does hereby grant, bargain, sell, convey and confirm unto
<br />MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR U.S. BANK,
<br />N.A. (hereinafter "Grantee" where appropriate), the following-described real property in Hall County,
<br />Nebraska, to wit:

<br />Lot 10, Block 88, in Wheeler and Bennett's Fourth Addition to the City of
<br />Grand Island, Hall County, Nebraska
<br />
<br />to have and to hold the above-described premises together with all tenements, hereditaments and appurtenances
<br />thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. Grantor does hereby
<br />covenant with Grantee and Grantee's successors and assigns:
<br />
<br />1. That CLARENCE L. SKARNIAK and JULIE A. SKARNIAK, husband and wife, Trustors,
<br />failed to pay to Beneficiary payments which were contractually due, and the Grantor, at the request of
<br />the Beneficiary, elected to declare the entire unpaid principal balance, together with interest thereon at
<br />once immediately due and payable.
<br />
<br />2. That a Notice of Default as required by ~ 76-1006 was filed by Grantor on February 1, 2006, as
<br />Instmment No. 2006-00901 in the office of the Register of Deeds of Hall County, Nebraska. A copy
<br />of said Notice of Default was thereafter mailed to all parties entitled to notice, pursuant to said Deed of
<br />Trust and in compliance with S 76-1008, R.R.S. Nebraska.

<br />3. That the Trustors failed to cure the default referenced in the Notice of Default within 30 days after
<br />filing of the Notice of Default.
<br />
<br />4. That a Notice of Tmstee's Sale was filed by Grantor on March 10, 2006, as Instrument No. 2006-
<br />02108 in the office of the Register of Deeds of Hall County, Nebraska. A copy of said Notice of the
<br />time and place of the sale was thereafter mailed to all parties entitled to notice pursuant to said Deed of
<br />Trust and in compliance with ~ 76-1008, RR.S. Nebraska.
<br />
<br />5. That Grantor as required by S 76-1007 published Notice of Trustee's Sale to be held on April 18,
<br />2006, at 9:00 a.m. in the lower lobby oftlv.: Hall County Courthouse, III West First Street, Grand
<br />Island, Nebraska. Said Notice was published in the Grand Island Independent, a legal newspaper of
<br />Grand Island, Hall County, Nebraska, once a week for five consecutive weeks conllnencing on March
<br />9, 2006, and ending April 6, 2006. The last publication notice was at least ten days prior to the
<br />Trustee's Sale held on April 18, 2006, and said sale was not later than 30 days after the last publication
<br />of notice.
