<br />This instrument, made this ---.L. day of December, 2005, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor",
<br />pursuant to a power of sale contained in that certain Deed of Trust recorded on April 1, 1999 as
<br />Instrument No. 99-103382 and re-recorded on April 8, 1999 as Instrument No. 99-103681 and re-
<br />recorded on May 5, 1999 as Instrument No. 99-104681 in the office of the Register of Deeds of Hall
<br />County, Nebraska, and the Secretary of the Department of Housing and Urban Development,
<br />hereinafter called "Grantee":

<br />WHEREAS, on August 12,2005, Eric H. Lindquist, as Successor Trustee, executed a Notice
<br />of Default pursuant to which notice was given to Matthew J. Lemburg, a single person, Trustor,
<br />under that certain Deed of Trust recorded on April 1, 1999 as Instrument No. 99-103382 and re-
<br />recorded on April 8, 1999 as Instrument No. 99-103681 and re-recorded on May 5, 1999 as
<br />Instrument No. 99-104681 in the office ofthe Register of Deeds of Hall County, Nebraska, covering
<br />that certain premises described as:
<br />
<br />Center 1/3 of Lot 1, of Win dolph's Subdivision ofa Part of the W1I2 NE1/4 and a Part
<br />of the E1I2 NW1I4 of Section 14, Township 11 North, Range 9, West of the 6th P.M., in
<br />Hall County, Nebraska, more particularly described as follows:
<br />Commencing at the Northeast corner of said Lot 1, running thence West of the North
<br />line of said Lot 1, a distance of 83.71 feet to the actual point of beginning, thence
<br />running South parallel with the East line of said Lot 1, a distance of 907.5 feet,
<br />running thence West parallel with the North line of said Lot 1, a distance of 83.71
<br />feet, more or less, (said distance being the center 1/3 of said Lot at this point); thence
<br />running North parallel with the West line of said Lot 1, a distance of907.5 feet to the
<br />North line of said Lot 1, being 83.71 feet East of the Northwest corner of said Lot 1;
<br />running East on the North line of said Lot 1, a distance of 83.71 feet to the point of
<br />beginning,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on August 15,2005 as Instrument No. 0200507903.

<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 R.R.S. Nebraska.
<br />
<br />Subsequent thereto, beginning on September 22, 2005, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on November 3, 2005. Publication of such notice
<br />was made for five consecutive weeks on September 22,2005, September 29,2005, October 6,2005,
<br />October 13, 2005 and October 20,2005, the last publication being at least ten (10) days but not more
<br />than thirty (30) days prior to the date of sale.
