<br />RE-RECORDED <br />20060081. <br /> <br />200600669 . <br /> <br />easement shall be appurtenant to and shall pass with title to every Suite, <br />subject to the following provisions: <br /> <br />a) The right of the Association to promulgate and publish reasonable Rules <br />and Regulations as provided in this Declaration. <br /> <br />b) The right of the Association to close or limit use of the Common Elements <br />while maintaining, repairing and making replacements in or to the <br />Common Elements <br /> <br />6) Delegation of Use. Suite Owners may delegate their right of enjoyment to the <br />Common Elements and facilities, but not their voting rights, to their tenants <br />or contract purchasers who occupy the relevant Suite. <br /> <br />7) No Partition of Common Elements. The Common Elements are not subject to <br />partition, and any purported conveyance, encumbrance, judicial sale, or other <br />voluntary or involuntary transfer of an undivided interest in the Common <br />Elements made without the Suite to which that interest is allocated is void. <br /> <br />ARTICLE 7. LIMITED COMMON ELEMENTS <br /> <br />1) Limited Common Elements. "Limited Common Elements" means a portion <br />of the Common Elements designated in this Declaration, on the Plat or Map, <br />or by the Act for the exclusive use of one (1) or more, but fewer than all, of the <br />Suites. The portion of the basement allocated to each Suite as set forth on <br />attached Exhibit "B" is also a Limited Common Element appurtenant to each <br />Suite as indicated on said Exhibit. Regarding those Limited Common <br />Elements set forth on the Plat or Map, such Limited Common Elements shall <br />be allocated to the Suite to which the Limited Common Element is attached <br />or, if not attached, adjacent. This allocation may not be altered without the <br />Approval of the Suite Owners whose Suites are affected by such reallocation. <br /> <br />2) Allocation of Specified Common Elements. The Board of Directors may <br />designate part of the Common Elements from time to time for use by less <br />than all of the Suite Owners or by non-owners for specified periods of time. <br /> <br />3) Expense Allocation. Any Common Expense associated with the maintenance, <br />repair, or replacement of a Limited Common Element shall be assessed <br />against the Suite to which the Limited Common Element is assigned. <br /> <br />9 <br />
