<br />200512063 <br /> <br />ARTICLE IV <br /> <br />MAINTENANCE AND MAINTENANCE ASSESSMENTS <br /> <br />Section 1. Creation of the Lien and Personal Obligation of <br />Assessments. The Declarant for each Lot owned, hereby covenants, <br />and each Owner of any Lot by acceptance of a deed therefore, <br />whether or not it shall be so expressed in such deed, is deemed to <br />covenant and agree to pay to the Association monthly assessments <br />or charges, such assessments to be established and collected as <br />hereinafter provided. The monthly assessments, together with <br />interest, costs, and reasonable attorney's fees, shall be a charge <br />on the land and shall be a continuing lien upon the property <br />against which each such assessment is made. All subsequent <br />purchasers shall take title subj ect to said lien and shall be <br />bound to inquire of the Association as to the amount of any unpaid <br />assessments. <br /> <br />Section 2. Purpose of Assessments. The assessments levied <br />by the Association on said Lots shall be used for the maintenance <br />of the Lots comprising the Properties. <br /> <br />Section 3. Exterior Maintenance. <br /> <br />(a) The Association shall provide maintenance upon each <br />Improved Lot which is subj ect to assessment hereunder, <br />as follows: paint, repair, replace and care for roofs, <br />gutters and exterior surfaces of residences, trees, <br />shrubs, grass and walks. Such maintenance shall not <br />include maintenance of lawn or vegetation within the <br />patio or yard walls or fences, or air conditioning <br />compressors. In the event an Owner shall fail to <br />perform his portion of the maintenance of the premises <br />and improvements situated thereon in a manner <br />satisfactory to the Board of Directors, the <br />Association, after approval by Two-Thirds (2/3) vote of <br />the Board of Directors, shall have the right, through <br />its agents and employees, to enter upon said Lot and to <br />repair, maintain, and restore the yard and landscaping <br />and any other improvements erected thereon. The cost <br />of such exterior maintenance shall be added to and <br />become part of the assessment to which such Lot is <br />subject. <br /> <br />(b) The Association shall be responsible for the <br />maintenance and repair of the lawn sprinkler control <br />system, water meter for said lawn sprinkler control <br />system, and water fees. Owner shall be responsible for <br />maintenance and repair for all service lines for water, <br />gas and sanitary sewer service to the dwelling unit <br /> <br />-3- <br />
