200512063 Section 4. "LOT" shall mean any part, parcel or portion of a platted Lot within the Properties upon which a dwelling unit or building is or shall be constructed as currently approved. Section 5. "IMPROVED LOT" shall mean and refer to any Lot on the Properties upon which a dwelling has been erected. Section 6. "DECLARANT" shall mean and refer to Gary Eilenstine and Linda Eilenstine, husband and wife, their successors and assigns, if such successors or assigns should acquire more than one undeveloped Lot from the Declarant for the purposes of development. Section 7. "UNIMPROVED LOT" shall mean all Lots other than Improved Lots, lots which are vacant or upon which a dwelling is being erected, the construction of which is not completed. Section 8. "MEMBER" shall mean and refer to every owner of a lot which is subject to Association assessments. ARTICLE II MEMBERSHIP Every Owner as defined in Article I, Section 2, under this Declaration shall be a Member of the Association. No Owner shall have more membership than the number of Lots owned by such Owner. Memberships shall be appurtenant to and may not be separated from the ownership of the Lots. Ownership of a Lot or Lots shall be the sole qualification for membership. Membership in the Association shall also include the Owners of any other Lots over which the Association shall have been given jurisdiction by annexation. ARTICLE III VOTING RIGHTS The Association shall have one class of voting membership. Voting Members shall be all Owners of the Properties, including Declarant, and shall be entitled to one vote for each Lot owned. When more than one person holds an interest in any Lot, all such persons shall be Members. The vote for such Lot shall be exercised as they among themselves determine, but in no event shall more than one vote be cast with respect to any Lot. -2-
