<br />, , <br /> <br />~. . <br />.~1' 1'..., <br />10 .....,>,J <br /> <br />AGREEMENT <br /> <br />200510858 <br /> <br />THIS AGREEMENT entered into between JAMES E. CASSEY and <br />MARGARET A. CASSEY, each in his and her own right, and as the <br />spouse of each other, and still as Joint Tenants, FIRST PARTIES, <br />and HELENE M.PETERSON, SECOND PARTY. <br />First Parties are now the owners of Lots Sixteen (16) and <br />Seventppn (17), on the East side of the West Portion of Kuester <br />Lake. Second Party is now the owner of Lot Eighteen (18) <br />abutting said Lot Seventeen (17), to the South thereof and also <br />on the East side of the West portion of said Kuester Lake. <br />First Parties hereby assign and sell, without further <br />documenta~ion, to Second Party all their leasehold interest in <br /> <br />, <br /> <br />a triangular tract described as TRACT A.\~he legal description <br /> <br />exhibit attached hereto. Second Party hereby assigns and sells <br /> <br />to First Parties, as Joint Tenants, without further documentation, <br /> <br />all of her interest in a tract described as TRACT B. and as <br /> <br />described in the legal description exhibit attached hereto. <br />Each of the parties agree that a new boundary line is hereby <br />established between said Lot Seventeen (17) and Lot Eighteen (18) <br />to conform with the transfers of lease interests herein contained <br />and the Arbitration Agreement dated August 15, 1976 pertaining <br />to the lot line between said Lots 17 and 18 is hereby so modified <br />and such Arbitration Agreement is thereby revoked. <br />Each of the parties also hereby assign to the other the lease <br />rights they now own in the premises that are hereby transferred <br />to the other. <br /> <br />Seco~d Party will pay to First Parties, on settlement, the <br /> <br /> <br />sum of F'ive Thousand Dollars ($5,000.00), as the only dollar <br /> <br /> <br />consideration being transferred under this agreement. <br /> <br /> <br />There will be no proration of either personal taxes or prepaid <br /> <br /> <br />assessment to Kuester Lake, Inc. as between the parties and with <br /> <br /> <br />respect to the leasehold interests hereby exchanged. <br /> <br />It is agreed that the 1akefront footage of Lot Eighteen (18) <br />remains at 75 feet and the 1akefront footage of Lots Sixteen (16) <br />and Seventeen (17) remain at 190 feet. <br />
