<br />200510853 <br /> <br />"Bond Fund" shall mean the Fund created pursuant to Section 5.02 of <br />Article V of the Indenture into which the Payments due under this Agreement shall <br />be deposited. <br /> <br />"Bond Purchase Agreement" shall mean that Bond Purchase Agreement to <br />be entered into by and between the Underwriter and the Corporation and approved <br />by the City providing for the sale of the Building Bonds to the Underwriter upon the <br />terms and conditions set forth therein. <br /> <br />"Building Bonds" or "Bonds" shall mean the Building Bonds (Library <br />Project), Series 2005, to be issued by Lessor pursuant to the Indenture to provide <br />funds for the Proj ect. <br /> <br />"Construction Fund" shall mean the fund created pursuant to Section 6.01 of <br />Article VI of the Indenture to be maintained by the Trustee and into which the net <br />principal proceeds of the sale of the Building Bonds shall be deposited to be <br />disbursed for payments due for costs related to the Project. <br /> <br />"Contractor" shall mean that contractor or contractors designated by the <br />Lessor and approved by the City to effect the construction and acquisition of the <br />Project. <br /> <br />"Costs of Issuance Fund" shall mean the fund created pursuant to Section <br />6.05 of Article VI of the Indenture to be maintained by the Trustee and into which <br />certain of the principal proceeds of the sale of the Building Bonds shall be deposited <br />to be disbursed for payments related to the expenses for issuance of the Building <br />Bonds. <br /> <br />"Indenture" shall mean that Trust Indenture and Security Agreement to be <br />entered into by and between Lessor and the Trustee governing the Building Bonds. <br /> <br />"Project" shall mean the Site and the library addition and related <br />improvements, fixtures, furniture and equipment to be located on the Site. Said <br />building and related improvements, fixtures, furniture and equipment are described <br />in greater detail on Exhibit A hereto attached, which is by such reference <br />incorporated herein. <br /> <br />"Site" shall mean the real estate located in the City of Grand Island, Hall <br />County, Nebraska, more particularly described on Exhibit "A" attached hereto. <br /> <br />"Trustee" shall mean that state or national bank or trust company designated <br />by the Lessor and approved by the City to serve as trustee under the Indenture and <br />any successor or successors as such trustee under the Indenture. <br /> <br />"Underwriter" shall mean Arneritas Investment Corp. (or any other firm of <br />municipal bond underwriters designated by the Lessor and approved by the City) - <br /> <br />2 <br />
