200315719 <br />Property; (B) with respect to any Burdened Property or portion thereof containing <br />Improvements used as a restaurant or for any entertainment purpose, which <br />Improvements contain less than 5,000 gross square feet, such Burdened Property or <br />portion thereof must contain 10 legally - conforming parking spaces for every 1,000 <br />gross square feet of Improvements located upon such Burdened Property and (C) <br />with respect to any Burdened Property or portion thereof containing Improvements <br />used for any use other than a restaurant or other entertainment purpose, such <br />Burdened Property or portion thereof must contain six legally - conforming parking <br />spaces for every 1,000 gross square feet of Improvements located upon such <br />Burdened Property. In addition, every owner and lessee of the Burdened Property <br />and any portion thereof shall cause landscaping areas to be added and maintained on <br />such Burdened Property in conjunction with any Improvement constructed on the <br />Burdened Property. <br />f. All of the Burdened Property shall be kept neat, orderly, planted with grass and <br />trimmed at all times. <br />g. Subject to the prior written consent of Declarant, the Burdened Property shall be used <br />for retail purposes only; provided, however, that no Burdened Property may be used <br />as a theater, night club, bowling alley, health spa, cafeteria, porn shop, billiard parlor <br />or other place of recreation or amusement, or as a business serving or selling <br />alcoholic beverages, or as a discount department store or as a variety, general or <br />"dollar" store. <br />h. Every owner and lessee of the Burdened Property or any portion thereof shall <br />maintain comprehensive public liability insurance covering such Burdened Property <br />with liability limits of at least $1,000,000.00 for each occurrence, bodily injury and <br />property damage combined; and shall also maintain property damage /all -risk hazard <br />insurance in the full replacement cost of all Improvements located upon such <br />Burdened Property. Such insurance policies shall (i) be carried with reputable <br />companies licensed to do business in the state in which such Burdened Property is <br />located and (ii) not be subject to change, cancellation or termination without at least <br />thirty (30) days' prior written notice to Declarant. <br />2. Declarant grants to PVSB a non - exclusive easement in, on, over and across all parking <br />areas of the Burdened Property as set forth on the Site Plan for the purposes of parking and pedestrian and <br />vehicular egress and ingress. The easement granted hereunder shall be for the use of PVSB, any affiliate <br />of PVSB, any other owner of the Bank Property, and any of their respective members, partners, officers, <br />employees, agents, licenses, invitees and customers. Declarant agrees that PVSB, any affiliate of PVSB <br />or any other owner of the Bank Property shall not be responsible for any costs associated with the <br />maintenance and/or repair of the easement granted hereunder. Declarant agrees that the easement granted <br />hereunder shall run with the land and shall be binding upon the Burdened Property and any person who <br />3 <br />
