8. RETIREMENT PLANS: The Petitioner shall receive as her sole and separate <br />property, free and clear of any interest of the Respondent, any and all pension and /or 401 K <br />plans which have been generated through her present or former employments. Therefore, <br />the Petitioner shall receive the Qwest 401 K Plan that she has generated through her <br />employment which is known as the Qwest Savings and Investment Plan, and the Petitioner <br />shall also receive as her sole and separate property her Qwest Pension Plan. The <br />Respondent agrees to sign any and all documents that are required by these plans to <br />release any interest that he may have heretofore held in said plans by virtue of being the <br />spouse or potentially a surviving spouse of the Petitioner. <br />The Respondent shall receive as his sole and separate property, free and clear of <br />any interest of the Petitioner, the 401 K Plan that he generated through his employment <br />with Chief Industries. The Petitioner agrees to sign any and all documents that are <br />required by this plan to release any interest that she may have heretofore held in said plan <br />by virtue of being the spouse or potentially a surviving spouse of the Respondent. <br />9. MISCELLANEOUS PROPERTY: The Petitioner shall receive as her sole and <br />separate property her interest in the Poker Flat Investment Club, the 2001 Federal Tax <br />Refund in the approximate amount of $2031.00, the Ameritrade Account No. 179-358114, <br />the Edward Jones Account No. 912- 04502 -1 -9, the Verizon Stock, the Lucent Stock, the <br />S.B.C. Stock, the AT & T Stock, and any other interest in communication's stocks. <br />The Respondent shall receive as his sole and separate property any account <br />receivables for the sale of the Mazda automobile, and any interest in the Janus Fund. <br />10. LEGAL ACTION FOR JACOB'S DEATH: The parties agree that they may <br />pursue legal action due to their son, Jacob's death. If recovery is made due to that action, <br />the parties agree that any financial recovery due to Jacob's death shall be divided evenly <br />between the parties. <br />11. LOAN ON PETITIONER'S 401 K PLAN: The Petitioner shall pay and hold the <br />Respondent harmless from a loan on her 401 K Plan that is in the approximate amount of <br />$19,436.24. <br />0 <br />
