200313682 <br />16. The owner of each lot shall keep the vegetation and grass thereon cut to a height <br />less than eight (8) inches prior to construction, and shall keep the shrubs, vegetation and grass <br />thereon cut to a reasonable height after construction. There shall be no cottonwood trees planted. <br />17. No fences shall be constructed, on any lot in the subdivision, of barbed wire, <br />woven wire, or creosote - treated posts above ground or any other unsightly material. Privacy <br />fences may not exceed six (6) feet in height. <br />18. All public sidewalks shall be constructed to comply with the requirements of the <br />building codes and ordinances of the City of Grand Island, Nebraska and shall have the edge of <br />such sidewalk furthest from the street one (1) foot inside the street right -of -way unless otherwise <br />required or permitted by the building codes and ordinances of the City of Grand Island, <br />Nebraska. The acceptance of a deed of conveyance by any purchaser or purchasers of any lot or <br />lots shall be construed as consent thereto. Such sidewalks will be constructed not later than the <br />time the home is built and earlier if required by the building codes and ordinances of the City of <br />Grand Island, Nebraska. <br />19. These restrictive covenants, restrictions and conditions are to run with the land <br />and shall be binding on all persons and all parties claiming ownership of said lots, until January <br />1, 2014 at which time these Restrictive Covenants, Restrictions and Conditions shall be auto- <br />matically extended for successive periods of ten (10) years, unless changed or modified by a vote <br />of a majority of the then owners of the lots in said subdivision. <br />20. If any owner of any lot, or their heirs, devisees, personal representatives, succes- <br />sors, assigns or grantees, shall violate any of the restrictive covenants, restrictions and conditions <br />herein set forth, it shall be lawful for any other person or persons owning any real estate in said <br />subdivision to prosecute such proceedings at law or in equity against the person or persons vio- <br />lating or attempting to violate any such restrictive covenants, restrictions or conditions and to <br />prevent him from so doing or to recover damages for such violations. <br />21. If any of the restrictive covenants, restrictions or conditions herein set forth are <br />violated and declared void by a court of competent jurisdiction, the remaining restrictive cove- <br />nants, restrictions and conditions shall not be affected, but shall stay and remain in full force and <br />effect. <br />22. This agreement and the faithful performance of the terms thereof shall be binding <br />upon the successors, assigns and grantees of the Owner, and upon the purchaser or purchasers of <br />any lot or lots in said Summerfield Estates Third Subdivision in the City of Grand Island, Hall <br />County, Nebraska, and their heirs, devisees, personal representatives, successors, assigns or <br />grantees. Any purchaser or purchasers of any lot or lots in said Summerfield Estates Third Sub- <br />division in the City of Grand Island, Hall County, Nebraska, and their heirs, devisees, personal <br />representatives, successors, assigns or grantees agree to this DECLARATION OF <br />RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD <br />ESTATES THIRD SUBDIVISION IN THE CITY OF GRAND ISLAND, HALL COUNTY, <br />M <br />
