200313159 <br />(b) Broad Form Boiler and Machinery Insurance on all equipment and pressure fired <br />vessels or apparatus situate on the Premises, and providing for full repair and <br />replacement cost coverage; <br />(c) Flood Insurance in the maximum amount available at any time during the term of <br />this Deed of Trust that the Premises are designated as lying within a flood plain as <br />defined by the Federal Insurance Administration; <br />(d) Loss of Rents and/or Business Interruption Insurance covering risk of loss due to <br />the occurrence of hazards insured against under the policies required in <br />Subsections (a), (b) and (c) hereof in an amount equal to: (i) rental for a <br />twelve (12) month period, plus (ii) real estate taxes, special assessments, <br />insurance premiums and other expenses required to be paid by the tenants under <br />each lease of the Premises for such twelve (12) month period; <br />(e) Comprehensive General Public Liability Insurance covering the legal liability of <br />Trustor against claims for bodily injury, death or property damage occurring on, <br />in or about the Premises in such minimal amounts and with such minimal limits as <br />Beneficiary may reasonably require; <br />(f) Builders Risk Insurance and Worker's Compensation Insurance during the <br />making of any alterations or improvements to the Premises; and <br />(g) Such other forms of insurance as Beneficiary may require or as may be required <br />by law. <br />In addition, Beneficiary is to be furnished with such engineering data as it may require <br />regarding the risk of earthquake or sinkhole damage to the Premises. If Beneficiary shall <br />determine in its sole opinion that there is a material earthquake or sinkhole risk, or if insurance <br />against earthquake or sinkhole is required by law, Trustor will provide earthquake or sinkhole <br />insurance. Such insurance policies shall be written on forms and with insurance companies <br />which are satisfactory to Beneficiary, shall name as the insured parties Trustor and Beneficiary, <br />as their interests may appear, shall be in amounts sufficient to prevent Trustor from becoming a <br />co- insurer of any loss thereunder, and shall bear a satisfactory mortgagee clause in favor of <br />Beneficiary with loss proceeds under any such policies to be made payable to Beneficiary. All <br />required policies of insurance together with evidence of the payment of current premiums <br />therefor shall be delivered to Beneficiary and shall provide that Beneficiary shall receive at least <br />thirty (30) days' advance written notice prior to cancellation, amendment or termination of any <br />such policy of insurance. Trustor shall, within thirty (30) days prior to the expiration of any such <br />policy, deliver original policies evidencing the renewal of such insurance together with evidence <br />of the payment of current premiums therefor. Trustor shall at its expense furnish on renewal of <br />insurance policies or upon request of Beneficiary evidence of the replacement value of the <br />improvements on the Premises in form satisfactory to Beneficiary on renewal of insurance <br />policies or upon request of Beneficiary. Insurance coverage must at all times be maintained in <br />proper relationship to such replacement value and must always provide for agreed amount <br />coverage. <br />15311/53;09/30/03 -10- <br />
