Bodie, a single person, of 111 East 4''' Street, City of Grand <br />Island, County of Hall, State of Nebraska, herein referred to as mortgagor, does hereby sell, <br />mortgage, and convey to Heather Bowden, Kelli Bowden, and Megan Bowden, all of 136 <br />Ponderosa Drive, City of Grand Island, County of Hall, State of Nebraska, herein referred to as <br />mortgagee, the property, situated in the County of Hall, State of Nebraska, described as follows: <br />Part of Lot Three (3), Block Sixty Six (66), Original Town, now Grand Island, Hall <br />County, Nebraska, more particularly described as follows: <br />Commencing at the northwesterly corner of said Lot Three (3), running thence <br />southerly on the westerly line of said lot eighty eight feet (88'), thence easterly at right <br />angles seventeen and one -half feet (17' /z'), running thence at right angles in a southerly <br />direction forty four feet (44') to the alley in said block, running thence easterly at right <br />angles on the southerly line of said lot twenty six and one -half feet (26'h'), thence at right <br />angles northerly for a distance of one hundred thirty two feet (132') to the northerly line of <br />said lot, running thence westerly at right angles on the northerly line of said lot for a <br />distance of forty four feet (44') to the place of beginning, together with appurtenances <br />thereto belonging and all fixtures now or hereafter attached thereto or used in connection <br />with the premises herein described. <br />To have and to hold all of the property to mortgagee, forever, and for the uses herein set forth, to <br />secure the performance of the obligation contained herein, and the payment of the principal and interest of <br />the note executed and delivered concurrently herewith by mortgagor to mortgagee in the sum of Sixty <br />Thousand Nine Hundred Dollars ($60,900.00) bearing interest from and after August 22, 2003, at the rate of <br />six and one -half percent (6'h %) per annum on the unpaid balance until paid, principal and interest to be <br />paid, at 136 Ponderosa Drive, Grand Island, NE 68803, or at such other place as the holder may designate <br />in writing, delivered or mailed to mortgagor, in monthly installments of One Thousand One Hundred <br />Ninety -One and 58/100 Dollars ($1,191.58), beginning September 1, 2003, and continuing on the first day <br />of each month thereafter until the indebtedness is fully paid; except that, if not paid sooner, the final <br />payment thereof shall be due and payable on August 1, 2008. The terms of such note are incorporated herein <br />by reference. <br />Mortgagor covenants and agrees: <br />Mortgagor will pay the indebtedness as stated above. <br />2. Mortgagor is the owner of the property in fee simple and has good right and lawful <br />authority to sell and convey the same; the same is free and clear of any lien or encumbrance; mortgagor will <br />warrant and defend the title to the premises against the claims of all persons whomsoever. <br />3. Mortgagor shall pay immediately when due and payable all general taxes, special taxes, <br />special assessments, water charges, sewer service charges, and other taxes and charges against the property, <br />and all taxes levied on the debt secured hereby, and shall furnish mortgagee, on request, with the original or <br />duplicate receipts therefore. <br />
