Said roadway shall be constructed, operated and maintained at such locations as required by Grantee, in Grantees discretion, for purposes of access to and within Grantee's park area. The roadway shall not interfere with, impair, or infringe with the use of the levee for flood control purposes. 4. This easement shall not pass nor shall the same be construed to pass to the Grantee any fee simple interest or title to the lands described in said Exhibit A. Grantee's assignment of the easement shall be only to another governmental entity with the approval of the Grantor. THE GRANTOR AND THE GRANTEE FURTHER COVENANT that the lands of Grantor as described in said Exhibit "A" shall be maintained by Grantor as open space as required for compliance with Land and Water Conservation Fund Project 31 -00027 of the Nebraska Game and Parks Commission.
