PERPETUAL EASEMENT
<br />For and in consideration of one (1) Dollar and other good and valuable consideration, the
<br />receipt of which is hereby acknowledged, Central Platte Natural Resources District of Nebraska,
<br />Grantor, does hereby grant, convey and release unto the County of Hall, Nebraska, Grantee, a
<br />perpetual easement in, over and upon the following described land situated in the County of Hall,
<br />State of Nebraska, as described in Exhibit "A," which is attached hereto and incorporated herein
<br />by this reference, for the purpose of or in connection with the construction, use, operation and
<br />maintenance of a hard surface perimeter road upon Grantor's levee, for ingress and egress, and
<br />for recreational purposes by the Grantee and by Grantee's officers, employees, agents, guests,
<br />and invitees.
<br />THE RIGHTS AND PRIVILEGES HEREIN GRANTED SHALL BE SUBJECT TO THE
<br />FOLLOWING TERMS AND CONDITIONS:
<br />The Grantor shall provide the Grantee and Grantee's officers, employees, agents, guests, and
<br />invitees with continuous ingress, egress, and recreational use to the said property. Ingress,
<br />egress, and recreational use by Grantee's guests and invitees shall at all times be subject to
<br />Grantee's Park rules. Grantee shall not use nor permit its guests or invitees to engage in any
<br />action that impairs or may cause impairment of the integrity of Grantor's flood control
<br />facilities located within the easement area as described in Exhibit A. Motor vehicle traffic
<br />within the easement area, other than by maintenance equipment and authorized construction
<br />equipment, shall be limited to hard - surface roads.
<br />2. There is reserved to the Grantor, it successors and assigns, the right and privilege to use the
<br />above described land of the Grantor at any time, in any manner, and for any purpose not
<br />inconsistent with the full use and enjoyment by the Grantee, its successors and assigns, of the
<br />rights and privilege herein granted.
<br />The Grantee is hereby licensed and permitted to construct, operate, and maintain a paved
<br />roadway that portion of the south levee of the Wood River Project located within the real
<br />property as described in said Exhibit A. Any such road constructed by the County shall be
<br />maintained by the County, at County's expense. Maintenance shall include, but is not
