It is the intention and understanding of all of the parties to this Agreement that the lien or charge of the Deed of Trust last above mentioned, and of any renewals, replacements, or extensions of that Deed of Trust, shall be and remain at all times prior and superior to the Deed of Trust first above mentioned. 5. BENEFICIARY has presented to the TRUSTEE named in the Deed of Trust first above mentioned, GALEN F. STEHLIK, a written instruction directing the TRUSTEE named in the Deed of Trust first above mentioned, requesting said TRUSTEE to execute this Subordination Agreement in order to properly subordinate the position of the BENEFICIARY in the Deed of Trust first above mentioned to the position of the BENEFICIARY in the second Deed of Trust above mentioned, FIVE POINTS BANK. AGREEMENT To carry out the intention of the parties, and in consideration of the loan to be made by LENDER, FIVE POINTS BANK, to GARY R. JACOBSON and others, and in consideration of other good and valuable consideration, receipt of which is hereby acknowledged, it is hereby agreed and declared that the Deed of Trust last above mentioned, and of any renewals, replacements, or extensions of that Deed of Trust, shall be and remain at all times a lien or charge on the real property and the leasehold interest therein described in this Agreement prior and superior to the lien or charge of the Deed of Trust first above mentioned.
