JACOBSON, the Owner of a <br />leasehold interest in real property described in this Agreement, <br />hereinafter referred to as "OWNER "; GARY R. JACOBSON, Trustee of <br />the GENEVIEVE J. JACOBSON REVOCABLE LIVING TRUST dated March 14, <br />2003, present Owner of the Promissory Note secured by the Deed of <br />Trust dated May 1, 2003, and recorded May 5, 2003, as Instrument <br />No. 2003 -05583 in the Office of the Hall County Register of Deeds, <br />hereinafter referred to as "BENEFICIARY "; GARY R. JACOBSON, Trustor <br />named in the Deed of Trust to be given to FIVE POINTS BANK to <br />secure a Promissory Note hereinafter described herein, hereinafter <br />referred to as " TRUSTOR"; and FIVE POINTS BANK, Beneficiary named <br />in the Deed of Trust secondarily described in this Agreement, <br />hereinafter referred to as "LENDER". <br />RECITALS <br />1. TRUSTOR executed the Deed of Trust recorded as Instrument <br />No. 2003 -05583 in the Office of the Register of Deeds of Hall <br />County, Nebraska, to secure a Promissory Note in the original sum <br />of $39,089.19 dated May 1, 2003, in favor of GARY R. JACOBSON, <br />TRUSTEE of the GENEVIEVE J. JACOBSON REVOCABLE LIVING TRUST. <br />2. BENEFICIARY is the Owner of the Promissory Note secured by <br />the Deed of Trus s. identified in the immediately preceding paragraph <br />and is the named BENEFICIARY in said Deed of Trust. <br />3. OWNER is the present Owner of a leasehold interest in real <br />estate hereinafter described and is about to execute a Deed of <br />Trust as TRUSTOR naming FIVE POINTS BANK as LENDER as the <br />Beneficiary to secure a Promissory Note dated August 20, 2003, in <br />favor of LENDER and conveying in trust, real property and the <br />OWNER's leasehold interest therein legally described as: <br />Lot Eighteen (18), having a lake front footage 78' situated on <br />the West side of the West portion of Kuester's Lake, and being <br />on a part of the East Half of the Southwest Quarter (E1/2 <br />SW1 /4) of Section Thirteen (13), Township Eleven (11) North, <br />
