200309779 <br />AMENDMENT TO RESTRICTIVE COVENANTS AND CONDITIONS <br />OF <br />FRANCIS VILLA COURTYARD HOMEOWNERS ASSOCIATION, INC. <br />THE UNDERSIGNED, who constitute seventy -five percent (75 %) or more of the voting <br />members of Francis Court Subdivision, pursuant to the Restrictive Covenants and <br />Conditions filed May 1, 1998 as Document No. 98- 104090, hereby amend said Restrictive <br />Covenants as follows: <br />ARTICLE I, DEFINITIONS, shall have added thereto new sections 14 -17, which shall <br />read as follows: <br />ARTICLE I <br />DEFINITIONS <br />7. Common Areas. "Common Areas" shall mean Outlet "A," the private <br />street which is named Francis Drive. Outlet "A" also includes all areas outside of the <br />private fences around each lot. This includes all areas from the fences to the curbs along <br />W. Charles St., Adams Street and Koenig Street, but does not include the brick wall that <br />bounds the Association's property on the West. <br />14. Homeowners Dues. "Homeowner's Dues" shall mean the annual <br />assessment against each lot that has been converted to a monthly rate. Such dues shall be <br />paid in advance either monthly or per a schedule agreed to by the Board and the owner. <br />15. Special Assessments. "Special Assessments" shall mean any special <br />assessment other than the annual assessment levied for the purpose making capital <br />improvements. <br />16. Majority. "Majority Vote" shall mean, unless otherwise provided for <br />by statute or the Bylaws, any matter submitted to a vote at a meeting where a quorum is in <br />attendance and passage shall require the affirmative vote of at least fifty -one percent <br />(51 %) of the voting power present. <br />1. <br />1 <br />
