200507220 Grantor hereby covenants that no excavation, structure or obstruction will be construed or permitted on the Easement Area and no change will be made by grading or otherwise that would adversely affect Grantees use and enjoyment of the Easement Area. Notwithstanding the foregoing, Grantee acknowledges and agrees that there is an existing row of trees currently located within the Easement Area and Grantee covenants and agrees that the exercise of their rights hereunder shall not disturb or interfere with said trees. Grantee agrees to restore the Easement Area to its current condition after exercising any rights hereunder. The rights, conditions and provisions of this agreement shall run with the land and shall insure to the benefit of and be binding upon Grantor and Grantee and their respective successors and assigns. The declaration of trust establishing Grantor, a copy of which, together with all amendments thereto (the "Declaration'), is duly filed with the Department of Assessments and Taxation of the State of Maryland, provides that the name "SPTIHS PROPERTIES TRUST" refers to the Trustees under the Declaration collectively as Trustees, but not individually or personally, and no trustee, officer, shareholder, employee or agent of Grantee shall be held to any personal liability, jointly or severally, for any obligation of, or claim against, Grantee. All persons dealing with Grantee, in any way, shall look only to the assets of Grantee for the payment of any sum or the performance of any obligation.
