200507220 <br />Grantor hereby covenants that no excavation, structure or obstruction will be construed or <br />permitted on the Easement Area and no change will be made by grading or otherwise that would <br />adversely affect Grantees use and enjoyment of the Easement Area. Notwithstanding the <br />foregoing, Grantee acknowledges and agrees that there is an existing row of trees currently <br />located within the Easement Area and Grantee covenants and agrees that the exercise of their <br />rights hereunder shall not disturb or interfere with said trees. Grantee agrees to restore the <br />Easement Area to its current condition after exercising any rights hereunder. <br />The rights, conditions and provisions of this agreement shall run with the land and shall insure to <br />the benefit of and be binding upon Grantor and Grantee and their respective successors and <br />assigns. <br />The declaration of trust establishing Grantor, a copy of which, together with all amendments <br />thereto (the "Declaration'), is duly filed with the Department of Assessments and Taxation of the <br />State of Maryland, provides that the name "SPTIHS PROPERTIES TRUST" refers to the <br />Trustees under the Declaration collectively as Trustees, but not individually or personally, and <br />no trustee, officer, shareholder, employee or agent of Grantee shall be held to any personal <br />liability, jointly or severally, for any obligation of, or claim against, Grantee. All persons dealing <br />with Grantee, in any way, shall look only to the assets of Grantee for the payment of any sum or <br />the performance of any obligation. The provisions of this section shall survive termination of the <br />Easement. <br />{60416555; 1} <br />
