(r, <br />B _ C_ M <br />F= <br />° tin <br />4 <br />N co rl <br />N c-n <br />}a (W ^' G <br />r7a <br />Z3 r. > <br />OD rV <br />Cm <br />-.a cm o <br />Recording Information Above <br />7� <br />EASEMENT AGREEMENT <br />The undersigned ( "Grantor ") for and in consideration of $ e, O..R and other good and valuable <br />consideration, the receipt of which is hereby acknowledged, does hereby grant and convey unto <br />QUEST COMMUNICATIONS, a Colorado corporation ( "Grantee "), whose address is 1801 <br />California St. Suite 5200, Denver, CO 80202, and its successors, assigns affiliates, lessees, <br />licensees and agents a perpetual and non - exclusive easement to construct, modify add to, <br />maintain and remove such telecommunications facilities, electrical and gas facilities and other <br />appurtenances in connection therewith, from time to time, as Grantee may require upon, over and <br />across the following described property situated in the ounty of Hall, State of Nebraska, which <br />Grantor owns or in which the Grantor has an interest, (Easement Area) to wit: <br />SEE ATTACHMENTS "A" and "S" <br />All of which is situated in the NE 1/4 of section 17, Township I I -N, Range 9 -W, of the 6" P.M. <br />Grantor further conveys to Grantee the right to ingress and egress to and from the Easement Area <br />during all periods of construction, maintenance, installation, reinforcement, repair and removal <br />over and across Grantors lands. <br />Grantee shall indemnify and save harmless Grantor for all damages, loss or harm to person or <br />property as a result of Grantees negligent exercise of the rights and privileges herein granted. <br />Grantee shall have no responsibility for environmental contamination, which is either pre- <br />existing or not caused by Grantee. In performing any work within the Easement Area, Grantee <br />shall keep Grantor's Property free from all claims, mechanics liens or other encumbrances and <br />shall bind over or take such action necessary to release such liens or claims. <br />Grantor reserves the right to occupy, use and cultivate the Easement for all purposes not <br />inconsistent with the rights herein granted. <br />Grantor covenants that the Grantor is the fee simple owner of the easement Area.
