I <br />200505875 <br />ARTICLE II. <br />OBJECTIVES AND PURPOSE OF LEASE <br />Subsection 2.01 Use of leased Premises. <br />1. The Demised Land shall be used by the Department as the site for the construction <br />and operation of the Facility, including supporting facilities. The Department's use of the Facility <br />shall be as an Army aviation support facility and armory. The Facility may be used by the <br />Department for administration and training of units, military operations, and maintenance of <br />equipment of the Reserve Forces of the United States; or, in time of war, or national or state <br />emergency, by other units of the Armed Forces of the United States or other use by the Federal <br />Government or the State of Nebraska and Department until termination of this lease. <br />2. The Department shall consult with Authority's Executive Director in determining <br />standard helicopter approach routes to the Airport which shall be followed as closely as practical, <br />except in case of emergency as determined by Department. All legal consequences of departures <br />from the standard routes shall be borne by the Department to the extent permitted by law. <br />Subsection 2.02 Prohibited Uses. <br />The Tenant may not use any part of the Demised Land or the improvements located thereon <br />for any activity or other purpose than as set forth in Section 2.01, unless such use is approved by the <br />Authority. It is understood and agreed that the rights granted by this Agreement will not be <br />exercised by the Department in such a way as to interfere with or adversely affect the use, <br />operation, maintenance, or development of the Field. The Department will not intentionally use <br />radios or other electronic devices that create interference with ground or air communications at <br />the Field. No lights shall be placed on the premises which shine in an upward direction. The <br />Department will operate the Facility in compliance with all federal requirements, including but <br />not limited to noise level requirements, hazardous wastes and fuel storage. The Department, its <br />successors and assigns, shall not sell fuel or provide aeronautical services to the public. <br />ARTICLE M. <br />TERM OF LEASE <br />Subsection 3.01 Term. <br />1. The term of this lease is fifty (50) years. The lease term shall commence upon a date <br />determined by the Department which date shall be no earlier than November 1, 2005 and no later <br />than January 1, 2004.
