CJ <br />20050571' <br />6. Enter into leases of any kind as lessor or <br />lessee, and pay or receive rents, and otherwise deal with leased <br />property; <br />7. Receive debts, payments and property in full <br />or partial satisfaction of debts, accounts, security interests, <br />mortgages, deeds of trust, or other indebtedness; <br />8. Commence, prosecute, dismiss or defend all <br />actions or other legal proceedings concerning my estate or me; <br />9. Compound, submit to arbitration, or otherwise <br />settle or adjust any debt, demand or dispute; <br />10. Buy, encumber, exchange, pledge, retain, sell, <br />trade or transfer any stock, bond, bill, certificate, commodity <br />contract, coupon, debenture, draft, partnership interest, option, <br />warrant or other security and to vote, execute a proxy statement <br />or otherwise exercise all rights incidental to ownership of any <br />security; <br />11. Represent my estate or me before any office of <br />the Internal Revenue Service or any other taxing authority in <br />connection with any and all types of tax, and receive confidential <br />information and perform any and all acts that I can perform with <br />respect to any tax matters including the power to receive refund <br />checks and the power to sign returns on my behalf; <br />12. Transfer or convey any part or all of my real <br />estate or personal property to my Trustee named in any revocable <br />or irrevocable trust that I may have created, or create such a <br />revocable or irrevocable trust with dispositive provisions <br />generally consistent with my estate planning objectives; and <br />13. Alter, modify or terminate any revocable, or <br />irrevocable trust to the extent possible, that I may have created. <br />B. To exercise with respect to my person, even if I am <br />not legally incapacitated, any and all powers a guardian may <br />exercise as provided in Neb. Rev. Stat. 30 -2628, or any successor <br />statutes thereto. <br />ARTICLE I <br />-M. PURPOSE <br />I intend that the power and authority of my attorney in fact <br />be liberally construed in order to fulfill the purpose of the <br />appointment which is to create a simple and flexible mechanism to <br />provide for my care and comfort, manage my property and administer <br />my estate without court .involvement, even if I become disabled or <br />incapacitated. In the event formal protective proceedings are <br />initiated on my behalf, I nominate my attorney in fact, or <br />successor, for consideration by the court as my conservator or <br />guardian, or both, to serve without bond. <br />ARTICLE - oMP - - - <br />My attorney in fact may charge reasonable compensation for <br />services rendered on my behalf. <br />
