Kivett, Attorney at Law duly licensed to practice in the State of Nebraska, Trustee, in the exercise of the power of sale conferred upon him, does hereby execute and deliver this indenture, WITNESSETH THAT: WHEREAS, for a valuable consideration on March 24, 2003, Megan L. Twomey, a single person, Trustor, executed and delivered her Deed of Trust to Michael F. Kivett, as Trustee, and CitiFinancial, Inc. (MD), as Beneficiary, conveying the real estate hereinafter described in trust, with power of sale, in accordance with the terms and provisions set forth therein; that said Deed of Trust was thereafter recorded on March 25, 2003 in the office of the Register of Deeds of Hall County, Nebraska as Instrument No. 0200303469; and WHEREAS, the Trustor having defaulted in the payment of the indebtedness secured thereby and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited with the Trustee all promissory notes together with Notice of Default; and WHEREAS, in compliance with Sec. 76 -1006, Statutes of Nebraska, on the 17"' day of March, 2005, the Trustee filed a Notice of Default in the office of the Register of Deeds of Hall County, Nebraska, as Instrument No. 0200502289, which Notice fully complied with the requirements of said statute; and WHEREAS, in compliance with Sec. 76 -1008, Statutes of Nebraska, on the 22nd day of March, 2005, the Trustee mailed by certified mail, with postage prepaid, a copy of such Notice of Default with the recording date shown thereon, addressed to the following interested parties, to -wit: Megan L.
