Other Powers to Convey, Release Exercise Create or Enter Into: My Agent is authorized to convey or release contingent and expected interests in property, including marital property rights and any right of survivorship incident to joint tenancy, to exercise or release my powers as trustee, custodial trustee, personal representative, conservator, or donee of a power of appointment, to enter into contracts, to create trusts pursuant to the Nebraska Uniform Custodial Trust Act or other revocable or irrevocable trusts of property of the estate which may extend beyond my disability or life, and to exercise my rights to elect options and change beneficiaries under insurance and annuity policies and to surrender the policies for their cash value. ARTICLE 3 Third Party Reliance Section 3.1. Protection of Third Party: No person who relies in good faith on the authority of my Agent pursuant to this Durable General Power of Attorney shall incur any liability to me, my estate or my personal representative. Section 3.2. Alternate Agent, Affidavit, of Regarding Prior Agents: Any party dealing with any person named as Successor Agent pursuant to this Durable General Power of Attorney may conclusively rely on an affidavit of such Successor Agent that those persons named as prior Agents are no longer serving. ARTICLE 4 Administrative Provisions Section 4.1. Reasonable Compensation to Agent: My Agent shall be entitled to receive reasonable compensation for services rendered pursuant to this Durable General Power of Attorney. Section 4.2. Nomination of Guardian or Conservator: I hereby nominate my Agent as my conservator and as my guardian of the person. In the event that my Agent does not qualify or accept such conservatorship and guardianship, I hereby nominate my Successor Agent as my conservator and as my guardian of the person. In the event that neither my Agent nor my Successor Agent qualifies or accepts such conservatorship and guardianship, it is my express wish that in making this determination the court be guided primarily by the wishes of my children and relatives. It is my express request that the conservator and guardian be permitted to serve without bond. The conservator and guardian shall have power to deal and contract with themselves in the performance of their trust, and such transactions shall not be void or voidable. Section 43. Resignation. of Agent: My Agent and any Successor Agent may resign by the execution of a written resignation delivered to me or, if I am mentally incapacitated, by delivery to any person with whom I am residing or who has the care and custody of me, or, in the case of an Agent's resignation, by delivering to the Successor Agent. If no other person is available, a resignation may be made to the appropriate court. ARTICLE 5 Miscellaneous Provisions Section 5.1. Photocopies: My Agent is authorized to make photocopies of this Durable General Power of Attorney as frequently and in such quantity as my Agent shall deem appropriate. Each photocopy shall have the same force and effect as any original. Section 5.2. Nebraska Law: This Power of Attorney shall be construed and enforced under the law of the State of Nebraska.
