FENSTER, <br />Respondent <br />On November 25, 1981 this matter came on for hearing be- <br />fore the Court upon the Petition for Dissolution filed herein <br />by the Petitioner. Petitioner was present in Court with her <br />counsel of record, James D. Livingston; the Respondent was not <br />present in Court, nor represented by counsel. <br />Testimony was given by the Petitioner, and Exhibit 1, <br />the Property Statement of Petitioner, and Exhibit 2, a certified <br />letter sent to the Respondent's last known address, were offered <br />and received into evidence. <br />The Court, being fully advised in the premises, finds as <br />follows: <br />1. The Court has jurisdiction of the parties and the sub- <br />ject matter of -this action,and that due and proper service was <br />had upon the Respondent, and the Respondent has defaulted in <br />i <br />filing an answer. <br />2. That the marriage between the Petitioner and Respondent <br />is irretrievably broken and all efforts to reconcile have failed. <br />3.' That the parties have acquired certain property and <br />incurred certain debts and they should be just and equitably <br />divided. <br />4. That the minor children of the parties, Ryan D. <br />Fenster and Shannon L. Fenster should be in the custody of <br />the Petitioner. <br />IT IS THEREFORE ORDERED: <br />1. That the marriage between the Petitioner and Respondent <br />is hereby dissolved. <br />
