200502334 <br />Front Street, the City may create a paving district to perform such work. The Subdivider agrees to <br />waive the right to object to the creation of any paving district for Wilmar Avenue and West North <br />Front Street where they abut the subdivision if it fails to pave these streets as required herein. <br />The Subdivider agrees to waive the right to object to the creation of any paving or <br />repaving district for Old Potash Highway and Webb Road where they abut the subdivision. <br />The Subdivider agrees to remove the existing concrete on that portion of the existing <br />Wilmar Street that will be vacated in conjunction with the development of Martin's Third <br />Subdivision. <br />2. Water. Public water is available to the subdivision and the Subdivider agrees <br />to extend, connect and provide water service to all lots in the subdivision in accordance with plans <br />and specifications approved by the Director of Public Works and the Utilities Director, and subject to <br />the City's inspection. <br />The Subdivider agrees to abandon the existing public water main in the right -of -way <br />of Wilmar Avenue that will be vacated for the development of Martin's Third Subdivision. No water <br />connection will be allowed in Martin's Third Subdivision until the final development plans are <br />approved by the City Utilities Department that will vacate the existing water service lines. The new <br />water system will not be accepted into the City's public water system until the existing water system <br />is appropriately abandoned and approved as such by the City Utilities Department <br />3. Sanitary Sewer. Public sanitary sewer is available to the subdivision and the <br />Subdivider agrees to extend, connect and provide sanitary sewer service to all lots in the subdivision <br />in accordance with plans and specifications approved by the Director of Public Works, and subject to <br />the City's inspection. <br />-3- <br />
