<br />AMENDMENT
<br />TO
<br />EASEMENT AGREEMENT
<br />This Agreement made and entered into this _jv� day of2"iT 01, 2002, by and
<br />between Glenwood H. Hargens and Jane fl Hargens, husband and wife, individually and as
<br />trustees, referred to herein as Hargens whether one or more, and Barry W. Niedfelt and JoLymr
<br />Niedfelt, husband and wife, referred into herein as Niedflt whether one or mote.
<br />WHEREAS, Hargens is the owner of the following described real estate:
<br />'file Northwest Quarter (N W I /4), Section Twenty -Three (23), Township Eleven (1 1) North,
<br />Range Ten (10), West of the 61h P.M., Hall County, Nebraska, EXCEPTING therefrom the
<br />easterly Thirty -Five feet (35 ft.) thereof; and,
<br />WHEREAS, Niedfelt is the owner of the West Half of the Northeast Quarter (W I /2N EI /4)
<br />and the easterly Thirty -five feet (35 ft.) of the Northwest Quarter (NW 1 /4) or Section
<br />Twenty-Three (23), Township Eleven (11) North, Range'reu (10), West of the 6 P.M., Hall
<br />County, Nebraska; and,
<br />WHEREAS, Hargens is the owner of an easement dated July 31, 1980, recorded as
<br />document number 86- 105313, Register of Deeds Office Hall County, Nebraska u copy of
<br />which is attached hereto as Exhibit "A; unit
<br />WHEREAS, Hargens is the owner of an Easement across the easterly Thirty -Five Feet (35
<br />ft.) of the Northwest Quarter (N W 1/4), Section Twenty -Three (23), Township Elevco (1 1)
<br />North, Range Ten (10), West of the 6th P.M., Hall County, Nebraska, as described in the
<br />Quit Claim Deed recorded as document number 97- 103603 in the Register of Deeds Office,
<br />Hall County, Nebraska, a copy of which is attached hereto as Exhibit "B'; and,
<br />WHEREAS, Niedfell is now the owner of the land across winch the Ilargens casements
<br />exist as shown on Exhibits "A" & "B"; and Hargens and Niedfelt agree that the legal
<br />description of the easement area should be modified to ieFleet a change in its location.
<br />NOW, THEREFORE, for valuable consideration the adequacy and receipt of which is
<br />hereby acknowledged by both patties, Hargens and Niedfelt agree as follows:
<br />The Easement Agreement, document number 86- 105313, shown oil Exhibit "A" and the
<br />Quitclaim Deed, document number 97- 103603, shown on Exhibit "B ", shall romain in full force
