200212437 <br />The City hereby grants to Ace a license to use and occupy, subject to the terms of <br />this License Agreement, the public utilities easement located in Block Five (5), Kernohan and <br />Decker Addition to the City of Grand Island, Nebraska, and adjacent vacated Harrison Street. <br />2. It is agreed that Ace can construct, at its expense, an expansion to the existing <br />commercial building in, upon, and over the public utilities easement in the vacated alley in Block <br />Five (5), Kemohan and Decker Addition as long as the utilities located and supplied within such <br />easement are properly safeguarded by the following minimum requirements: <br />A. The existing sanitary sewer main shall be replaced with a new eight (8.0) <br />inch Ductile iron pipe with 40 mil Protecto 401 ceramic epoxy lining. Ace will have the <br />inspection and testing done by a Registered Professional Engineer and provide the City <br />with the Engineer's Certificate of proper construction and test results. <br />B. Ace shall submit a construction plan prepared by a Registered Professional <br />Engineer to the Director of Public Works for approval. The plan shall detail the existing <br />building with the proposed addition and the sewer line from Broadwell Avenue west to <br />vacated Harrison Street. <br />C. A manhole shall be installed at the west end of the new sanitary sewer. <br />The manhole shall be tested for infiltration and exHltration. <br />D. No service connections will be allowed under the building. <br />E. Where building foundation elements overlay the sewer, a Registered <br />Professional Engineer shall certify to the City's Director of Public Works that the loads <br />placed on the sewer by the foundation are no more than one - quarter of the load the sewer <br />is capable of supporting at those points. <br />3. The City and Ace agree that Ace's construction of the new sanitary sewer main in <br />the easement shall be under the direction of the field engineer retained by Ace, subject to the <br />inspection of the City's Director of Public Works or his authorized agents or employees. <br />4. The City shall have the right to maintain the new sanitary sewer main from the <br />manholes located outside of the commercial building. <br />2- <br />
