This License Agreement entered into by and between the CITY OF GRAND ISLAND, NEBRASKA, a municipal corporation, hereinafter referred to as the "City ", and HARDWARE LAND CO. OF GRAND ISLAND, LTD., a partnership, hereinafter referred to as "Ace ". WHEREAS, Ace is the owner of Lots One (1) through Eight (8), inclusive, in Block Five (5), in Kemohan and Decker Addition to the City of Grand Island, Hall County, Nebraska and vacated Harrison Street north of Third Street; and WHEREAS, Ace intends to expand a commercial building on said property. Such existing commercial building and proposed addition will be located over and upon the City easement retained in Block Five (5), Kemohan and Decker Addition (see Exhibit A attached hereto and incorporated herein by reference); and WHEREAS, the City and Ace desire to enter into a License Agreement which permits Ace to build upon and over the easement retained in Block Five (5), subject to certain conditions, more specifically enumerated herein.
