<br />2002, by and between S & W LAND & INVESTMENTS, A Wyoming Corporation, herein
<br />referred to as the "Lessor," and MARCO A. VELASQUEZ, NELLIE VELASQUES and
<br />NORA A. ZEPEDA, Unmarried Persons, herein referred to as the "Lessee." Pursuant to
<br />the terms and conditions set forth hereinafter, Lessor hereby agrees to lease to the Lessee s
<br />the "Premises," located at 440 East South Street, Grand Island, Nebraska, and legally
<br />described as:
<br />The Southerly Twenty -five (25) feet of the Westerly Ten (10) feet of Lot
<br />Seventy -one (71) and the Westerly Ten (10) feet of Lot Seventy -two (72), in
<br />Buenavista Subdivision, and all of Lot Sixty -six (66), Buenavista
<br />Subdivision, all in the City of Grand Island, Hall County, Nebraska.
<br />1. TERM. The term of this Lease Agreement shall be for a period of fifteen (15)
<br />years commencing on the 1 st day of November, 2002, and terminating on the 30th day of
<br />October, 2017. In the event that Lessee takes possession of the premises prior to September
<br />1, 2002, the Lessee shall pay a per diem rental of $22.29 per day for each day Lessee
<br />occupies the premises prior to November 1, 2002.
<br />2. RENT. Lessee agrees to pay, without demand, to the Lessor as rent for the
<br />above described Premises, the sum of $668.67 per month on the 1 st day of each calendar
<br />month beginning December 1, 2002, at S & W Land & Investments, 1314 Country Club
<br />Drive, Hastings, NE 68901 or at such other place as Lessor may designate. As additional
<br />rent, the Lessee agrees to pay from and after the date of possession, all real estate taxes
<br />upon the real estate; all special assessments levied upon or against the real estate; and all
<br />premises insurance premiums. The Lessee agrees to pay to the Lessor each month, an
<br />amount equal to one - twelfth of the estimated total annual cost of real estate taxes (currently
<br />estimated at $105.64 per month). Lessee agrees to purchase its own homeowners insurance
<br />for the premises. As a result of the foregoing, the amount owed by the Lessee beginning on
<br />December 1, 2002, shall be $774.31 per month, which amount shall be adjusted from time to
<br />time to account for fluctuations in real estate taxes.
<br />3. SECURITY DEPOSIT. Lessee is not required to pay any security deposit at this
<br />time.
<br />4. QUIET ENJOYMENT. Lessor covenants that on paying the rent and
<br />performing the covenants herein contained, Lessee shall peacefully and quietly have, hold
<br />and enjoy the Premises for the agreed term.
