<br />THIS TRUST DEED made this Z3 day of October, 2002, between &0. 0
<br />TAN NGOC PHAM and HOAI TRINH PHAM, Husband and Wife, as TRUSTOR,
<br />and PATRICK A. BROCK, 222 N. Cedar, Grand Island, Nebraska, A
<br />Member of the Nebraska State Bar Association, as TRUSTEE, and QUYEN
<br />THANH TRINH and MINHTHU THI TRUONG, Husband and Wife, hereinafter
<br />referred to as BENEFICIARIES.
<br />WITNESSETH:
<br />That TRUSTOR hereby grants, bargains, sells, conveys and
<br />warrants to TRUSTEE, IN TRUST, their successors and assigns, with
<br />power of sale, the following- described real property:
<br />LOT EIGHT (8), BLOCK SEVENTY -FOUR (74), ORIGINAL TOWN OF
<br />GRAND ISLAND, now City, Hall County, Nebraska, being a
<br />tract of land more particularly described as follows:
<br />Commencing at the Southeast corner of Block Seventy -four
<br />(74) and proceeding in a Northwesterly direction along
<br />and upon the East line of Block Seventy -four (74) a
<br />distance of One Hundred Thirty -two Feet (132') to the
<br />alley in said Block, thence proceeding in a Southwesterly
<br />direction a distance of Sixty -six Feet (66'), thence
<br />proceeding in a Southeasterly direction along and upon a
<br />line parallel to the East line of said Block Seventy -four
<br />(74) a distance of One Hundred Thirty -two Feet (1321) to
<br />the South line of Block Seventy -four (74), thence in a
<br />Northeasterly direction along said line a distance of
<br />Sixty -six Feet (661) to the point of beginning.
<br />together with all interest that the TRUSTOR now has or may
<br />hereafter acquire in and to said property and in and to (a) all
<br />easements and rights of way appurtenant thereto and (b) all
<br />buildings, structures, improvements, fixtures, equipment,
<br />furnishings and appurtenances now or after placed thereon and as
<br />described in the Offer to Purchase Real Estate as executed between
<br />the TRUSTOR and BENEFICIARIES. The TRUSTOR agrees to execute and
<br />deliver, from time to time, such further instruments as may be
<br />requested by the BENEFICIARIES to confirm the lien of this Deed of
<br />Trust on any of the aforementioned property. The property so
<br />conveyed hereunder is hereinafter referred to as the "property ".
<br />The TRUSTOR hereby covenants and agrees with the TRUSTEE that
<br />they are lawfully seized and the owner of the above - described
<br />property; that TRUSTOR will warrant and defend the title to said
<br />premises forever against the claims of all persons whomsoever.
<br />For the purpose of securing performance of each agreement of
<br />TRUSTOR herein contained and the payment of TWENTY -ONE THOUSAND
<br />DOLLARS ($21,000.00), the TRUSTOR has executed a Promissory Note
<br />bearing even date, on the terms and conditions as set forth in such
<br />Note until paid. The principal sum shall be payable in accordance
<br />with and upon the terms and conditions as set forth in such Note
<br />until paid. The principal sum shall be payable in accordance with
<br />and upon the terms and conditions of said Note of even date, and in
<br />any event the entire principal balance due hereunder shall be paid
<br />on or before October 1, 2012. All installment payments hereunder
<br />shall be applied to the unpaid balance, pursuant to the terms of
<br />the Note, a copy of which has been provided to each of the parties
