200209089 <br />may proceed to foreclose this Contract as provided by law, or <br />take such other and further legal action as may be available to <br />them. <br />(12) Waiver. Any waiver by the Sellers of the time or manner <br />of payment due hereunder or the time or manner of performance of <br />acts required hereunder of the Buyers on one occasion, shall not <br />constitute a waiver or relinquishment of any right of the Sellers <br />to demand subsequent payments when due, or to demand performance <br />by the Buyers in accordance with the terms of this Agreement on <br />any other or subsequent occasion. <br />(13) Obligations of the Buyers. The Buyers agree to pay the <br />real estate taxes and provide insurance as above set forth, and <br />further agrees to keep all improvements on the above real property <br />in good condition and repair, ordinary wear and depreciation <br />excluded, and agrees not to destroy, remove or substantially <br />remodel any improvement without the prior written consent of the <br />Sellers. Buyers further agree to keep said property free and <br />clear of all liens, taxes and encumbrances at all times during <br />the term of this Contract. To the event that the Buyers should <br />abandon said property, then the Sellers may take immediate <br />possession of said property, and such further action available to <br />them. <br />(14) Assignment. Buyers agree riot to sublet the entire <br />property, and further agrees not to assign this Contract without <br />the prior written consent of the Sellers, which consent shall not <br />be unreasonably withheld. Any attempted assignment of the <br />Contract or surrender of the premises contrary to the terms <br />hereof, shall render the unpaid balance due hereunder immediately <br />due and payable in full at the option of the Sellers. The Buyers <br />further agree not to pledge, mortgage, alienate or in any way <br />encumber said property without the written consent of the Sellers, <br />and any attempt to do so shall be null an void and likewise render <br />the entire unpaid principal balance and interest immediately due <br />and payable at the option of the Sellers. <br />(15) Notice of Contract_. Upon execution of this Contract, <br />the parties are executing a Notice of Contract of Sale, which may <br />be recorded by either party hereto. <br />(16) Amortization Schedule. Each party hereby acknowledges <br />receipt of an amortization schedule showing the amount of each <br />payment, including principal and interest. <br />(17) Performance and Binding Effect. The parties agree that <br />this Contract constitutes the sole and entire agreement between <br />them respecting the sale of the above real property and personal <br />-4- <br />
