The United States of America ( "Govemnent ") was the owner of certain tracts of land on the former Comhusker Army Ammunition Plant, Hall County, Nebraska commonly known as Land Management Tracts 53 and 54 ( "Tracts 53 and 54 "). b. The Agricultural Institute of Nebraska, Inc., a non -profit corporation leased Tracts 53 and 54 from the Government and during the term of said lease contracted with Sponsor to conduct the annual Farm Show on Tracts 53 and 54. c. Section 2836(a) of the National Defense Authorization Act for Fiscal Year 1995 (Public Law 103 -337, 108 Star 2663, 3063) authorized the Secretary of Army to convey Tracts 53 and 54 to Hall County, Nebraska, Board of Supervisors, or its designee and said Board designated Sponsor to acquire Tracts 53 and 54 from the Government. d. Pursuant to the Offer to Purchase Real Property and Acceptance between Sponsor and the Government, and in order to continue the operation of the Farm Show, Sponsor purchased Tracts 53 and 54 on April 8, 2002. e.
