200208608 <br />2. Each building lot shall contain not more than one dwelling unit. The ground floor <br />living space in each one -story dwelling unit shall contain not less than 1,500 square feet. Any <br />split level or two -story dwelling unit shall have a minimum of 900 square feet on the ground <br />floor. The minimum square footage required in this paragraph shall be exclusive of open <br />porches and of any garage attached to the dwelling unit. <br />3. Each dwelling unit shall contain at least an attached double garage and no more <br />than a three -car garage, and driveway entrance from the public street in the Subdivisions. <br />4. No building or dwelling unit shall be moved onto said Subdivisions and placed <br />upon any building lot, such as modular homes. All dwellings shall be built from the foundation <br />up on said lots in said Subdivisions. No trailer, mobile home, tent, garage, shack, basement <br />or secondary buildings or any other structure of a temporary nature shall be placed as a <br />residence or dwelling unit in said Subdivisions. <br />5. No secondary building shall be permitted on any building lot in the Subdivisions, <br />except that a "boat shed" may be constructed on a building lot as long as the material, design, <br />and quality of the construction is the same as that of the dwelling unit. Fences are allowed <br />so long as they do not block any other lot owner's view of the lake from any location on any <br />other lot. <br />6. No wrecked, dismantled, worn out, inoperable, or discarded automobiles, trucks, <br />trailers, boats, machinery, or parts therefrom, or any other junk or waste material shall be <br />deposited or stored on any lot. Any boats or trailers owned by lot owners for the personal use <br />of the Owner shall be parked to the lake front side of each lot. <br />7. No billboard or sign board shall be erected or allowed to remain on any lot, <br />except for suitable signs for advertising the sale of lots. <br />8. No outside television or radio antennas shall be permitted in the Subdivisions. <br />No radio transmitting or receiving tower or pole shall be located in the Subdivisions. Small <br />dishes for television reception shall be allowed. Larger satellite dishes will not be permitted, <br />except there is one large satellite dish now existing which shall be grandfathered. Once that <br />particular satellite dish is no longer usable, the Owner cannot replace it with another large <br />satellite dish. <br />9. No animal shall be permitted to be kept or maintained in the Subdivisions, except <br />for small household pets, such as dogs, cats, and other similar domestic pets. There shall be <br />a limit of four small household pets per household unit. No horses or other large animals shall <br />be permitted in the Subdivisions. Chickens shall not be permitted in the Subdivisions. All pets <br />shall be restricted to their owners' premises unless leashed or under responsible supervision. <br />10. The Owner or tenant of each lot shall keep the weeds and foliage thereon cut <br />and maintained in a neat appearance and in any event shall not permit weeds or other similar <br />vegetation to exceed six inches. <br />11. Each lot Owner or tenant, his family, and invitees, shall have the privilege of <br />using the lake located in the Subdivisions, as it may exist from time to time, for swimming, <br />fishing, and boating; provided that only said boats not powered by fossil fuels shall be allowed, <br />including but not limited to, sailboats, row boats, canoes, pontoon boats, and any other <br />floating devices propelled by human power. All boats propelled by engines using fossil fuels <br />and electric power are prohibited. Boating and fishing shall not be permitted closer than forty <br />(40) feet from the shoreline in any location, except that each lot Owner or tenant, his family, <br />and invitees may swim, fish, and boat within the forty (40) feet area immediately adjacent to <br />such lot Owner or tenant's shoreline. The Owner or tenants of each lot shall take all <br />precaution to avoid polluting or littering the lake in the Subdivisions. <br />12. There shall be no liability of any kind upon the Rainbow Lake Home Owners <br />Association, Inc., a nonprofit corporation, or their successors and assigns for any accident, <br />injury, loss, or damage incurred to any person or persons in connection with the use of, or <br />persons at, or on the lake in the Subdivisions, and any lot or lots in the Subdivisions and the <br />use by any lot Owner or tenant or their assigns, their guests, licensees, invitees, or agents shall <br />be at the sole risk of said Owner, tenant, or their guests, licensees, invitees, or agents. <br />
