WHEREAS, the undersigned are the Owners of all lots in Rainbow Lake Subdivision,
<br />Rainbow Lake Second Subdivision, Rainbow Lake Third Subdivision, and Rainbow Lake Fourth
<br />Subdivision, in Hall County, Nebraska, all located in the North Half of the South Half of the
<br />Northwest Quarter (NY SY NW Y/) of Section Thirty -Three (33), Township Eleven (11), North
<br />Range Nine (9), West of the 6th P.M., Hall County, Nebraska; and
<br />WHEREAS, there are no protective covenants, restrictions, and conditions of record for
<br />Rainbow Lake Second Subdivision, Rainbow Lake Third Subdivision, and Rainbow Lake Fourth
<br />Subdivision, in Hall County, Nebraska; and
<br />WHEREAS, it is the desire of the aforesaid Owners of Rainbow Lake Subdivision to
<br />terminate the existing Protective Covenants, Restrictions, and Conditions for Rainbow Lake
<br />Subdivision, in Hall County, Nebraska, recorded as Document No. 78- 005761, in the Office
<br />of the Register of Deeds of Hall County, Nebraska, and establish one set of Protective
<br />Covenants, Restrictions, and Conditions for Rainbow Lake Subdivision, Rainbow Lake Second
<br />Subdivision, Rainbow Lake Third Subdivision, and Rainbow Lake Fourth Subdivision, in Hall
<br />County, Nebraska, in order to establish uniformity and a desirable subdivision of dwelling
<br />houses, and to encourage the sale of the remaining lots and construction of modern and
<br />desirable dwelling houses;
<br />NOW, THEREFORE, the Owners of Rainbow Lake Subdivision, Hall County, Nebraska,
<br />terminate the Protective Covenants, Restrictions, and Conditions for Rainbow Lake Subdivision,
<br />recorded in the Office of the Register of Deeds of Hall County. Nebraska, as Document No. 78-
<br />005761, and replace them with the following protective covenants, restrictions, and
<br />conditions, and in consideration thereof and the mutual benefits to be derived by the Owners
<br />of said Rainbow Lake Subdivision, Rainbow Lake Second Subdivision, Rainbow Lake Third
<br />Subdivision, and Rainbow Lake Fourth Subdivision, in Hall County, Nebraska, and any
<br />purchaser or purchasers, their heirs, successors, personal representatives, and assigns, the
<br />Owners hereby stipulate and agree that any and all lots in the aforementioned Subdivisions,
<br />sold, given, transferred, and conveyed shall be, and the same are, subject to the following
<br />protective covenants, restrictions, and conditions, all of which shall run with the land as
<br />follows:
<br />1 . All lots in the Rainbow Lake Subdivision, Rainbow Lake Second Subdivision,
<br />Rainbow Lake Third Subdivision, and Rainbow Lake Fourth Subdivision, shall be zoned,
<br />described, and used as residential lots. No apartment house, duplex or triplex shall be built on
<br />any lot, nor shall any basement house be built on any lot. No dwelling shall be erected for
<br />occupancy for more than one family, nor shall any dwelling be used for occupancy of more
<br />than one family. No commercial or industrial enterprises shall be conducted or operated in said
<br />Subdivisions. No lot or lots shall be divided or split to create smaller building areas, but lots
<br />may be combined or combined and divided to establish larger building areas.
