THAT Michael F. Kivett, Attorney at Law duly licensed to practice in the State of Nebraska,
<br />Trustee, in the exercise of the power of sale conferred upon him, does hereby execute and deliver this
<br />indenture,
<br />WITNESSETH THAT:
<br />WHEREAS, for a valuable consideration on April 1, 1999, Kirk S. Barnhill and Julie A.
<br />Barnhill, husband and wife, Trustors, executed and delivered their Deed of Trust to Jerry J. Milner, as
<br />Trustee, and Associates Financial Services Company of Nebraska, Inc., a division of CitiFinancial, Inc.
<br />(MD), as Beneficiary, conveying the real estate hereinafter described in trust, with power of sale, in
<br />accordance with the terms and provisions set forth therein; that said Deed of Trust was thereafter
<br />recorded on April 5, 1999 in the office of the Register of Deeds of Hall County, Nebraska as noted in
<br />Instrument No. 99- 103543; and
<br />WHEREAS, that on April 5, 2002, Associates Financial Services Company of Nebraska, Inc., a
<br />division of CitiFinancial, Inc. (MD), Beneficiary upon the aforementioned Deed of Trust, appointed
<br />Michael F. Kivett, Attorney at Law, as Successor Trustee, which Substitution of Trustee was recorded
<br />April 19, 2002, in Instrument No. 0200204292, in the Register of Deeds of Hall County, Nebraska. A
<br />copy of said Substitution of Trustee was served upon the prior Trustee, Jerry J. Milner, on or about April
<br />17, 2002; and
<br />WHEREAS, the Trustors having defaulted in the payment of the indebtedness secured thereby
<br />and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited
<br />with the Trustee all promissory notes together with Notice of Default; and
<br />WHEREAS, in compliance with Sec. 76 -1006, Statutes of Nebraska, on the 19th day of April,
<br />2002 the Trustee filed a Notice of Default in the office of the Register of Deeds of Hall County,
<br />Nebraska, as noted in Instrument No.0200204293, which Notice fully complied with the requirements of
<br />said statute; and
<br />WHEREAS, in compliance with Sec. 76 -1008, Statutes of Nebraska, on the 24th day of April,
<br />2002 the Trustee mailed by certified mail, with postage prepaid, a copy of such Notice of Default with
<br />the recording date shown thereon, addressed to the following interested parties, to -wit:
