20021901_84 FLOOD PROTECTION LEVEE EASEMENT - CORPORATION (page 2) PROJECT: 97- 0174.04 TRACT: 603 and which concrete box culvert shall consist of not less than four (4) tubes each of which shall have dimensions of eight (8) feet by four (4) feet and be not less than forty -three (43) feet long and shall be equipped with gates which will prevent fish from going through any of the tubes in the culvert. The levee and culvert shall be constructed and maintained by Grantee to allow the free flow of surface water from west to east at all times and to not interfere with gravel trucks, semi- trailers and other motor vehicles safe passage across the levee at any time. Grantee shall not construct or install any fences anywhere within the easement land area. The use, rights and privileges herein reserved to Grantor include, but are not limited to, the right to raise the level of Grantor's land north of the Grantee's levee by filling it with sand, dirt or other appropriate materials and joining that filled and raised land with Grantee's levee by raising and filling the north side of the levee in the same manner; and the right at Grantor's expense to extend the Grantee's levee to the south on Grantor's land. Grantor and Grantee further agree that this easement shall not be construed to allow Grantee to use any sand, gravel, dirt or other materials or property of Grantor without Grantor's express written prior approval nor to mean or imply that Grantor agrees with or acquiesce in the plans and ideas of Grantee which will result in changes of the flow and control of surface water whether those changes are intended by Grantee or not.
