20021901_84 <br />FLOOD PROTECTION LEVEE EASEMENT - CORPORATION (page 2) <br />PROJECT: 97- 0174.04 TRACT: 603 <br />and which concrete box culvert shall consist of not <br />less than four (4) tubes each of which shall have <br />dimensions of eight (8) feet by four (4) feet and be <br />not less than forty -three (43) feet long and shall be <br />equipped with gates which will prevent fish from going <br />through any of the tubes in the culvert. The levee and <br />culvert shall be constructed and maintained by Grantee <br />to allow the free flow of surface water from west to <br />east at all times and to not interfere with gravel <br />trucks, semi- trailers and other motor vehicles safe <br />passage across the levee at any time. Grantee shall <br />not construct or install any fences anywhere within the <br />easement land area. <br />The use, rights and privileges herein reserved to <br />Grantor include, but are not limited to, the right to <br />raise the level of Grantor's land north of the <br />Grantee's levee by filling it with sand, dirt or other <br />appropriate materials and joining that filled and <br />raised land with Grantee's levee by raising and filling <br />the north side of the levee in the same manner; and the <br />right at Grantor's expense to extend the Grantee's <br />levee to the south on Grantor's land. <br />Grantor and Grantee further agree that this <br />easement shall not be construed to allow Grantee to use <br />any sand, gravel, dirt or other materials or property <br />of Grantor without Grantor's express written prior <br />approval nor to mean or imply that Grantor agrees with <br />or acquiesce in the plans and ideas of Grantee which <br />will result in changes of the flow and control of <br />surface water whether those changes are intended by <br />Grantee or not. <br />
